Can I refuse the sobriety tests as I'm not driving and that I were NOT in danger of my self or others? What of he took me to jail? Do I have to submit a blood sample? The officer arrested me and then asked if I would submit to a blood test. I had said yes however I was never read my miranda rights. Did I even have the right to an attorney before consenting to that? Had I known that I may not have taken the blood test. I failed a field sobriety test but I was not high so it had to have been because of a mini-panic attack and back problems (both of which are ongoing and documented for years by doctors). This is my last question for this case, unfortunately I cannot afford an attorney and just want to make sure I have an idea of some of the legal facts before trying to find a public defender.
