I was pulled over Saturday night around 3 AM for " failure to operate within one lane " on the highway . I told the officer I had had a drink . I completed a couple field sobriety tests and blew into a Breathalyzer . He placed me in handcuffs , put me in the back of his car then said he needed me to take the breath test again . I asked him what I blew the first time and he said he wouldn't tell me unless I agreed to take it again . I told him I didn't want to do anything else without talking to a lawyer first . The officer got a search warrant to take my blood but still said I refused the chemical test . I was not allowed to talk to a lawyer before having blood drawn and being taken to jail . Is there any way a lawyer can save my license from the 18 month revocation at a OLD hearing ?

I wasn't walking really straight in the street and the officer stopped me and wanted to investigate me. Can I refuse the sobriety tests as I'm not driving and that I were NOT in danger of my self or others? What of he took me to jail? Do I have to submit a blood sample? I was arrested in Utah on 8/7/12 for DUI Drugs, Possession of Marijuana, Possession of Paraphernalia, and Following too Close. The officer arrested me and then asked if I would submit to a blood test. I had said yes however I was never read my miranda rights. Did I even have the right to an attorney before consenting to that? Had I known that I may not have taken the blood test. I failed a field sobriety test but I was not high so it had to have been because of a mini-panic attack and back problems (both of which are ongoing and documented for years by doctors). This is my last question for this case, unfortunately I cannot afford an attorney and just want to make sure I have an idea of some of the legal facts before trying to find a public defender.
