I would like to file bankruptcy specifically to discharge my DWI surcharges from 1998-99. What chapter will erase this in full?
All fines and court penalties have been paid. My motor vehicle surcharges are $13,511 which is the only thing holding me back from obtaining my license again... I do qualify under chapter 7 since I am receiving Gov. assistance from Social Services and have no assets, but my understanding from old case law is under chapter 7 surcharges can't be discharged. So I looked at chapter 13 and I don't have enough of disposable cash or income after expenses to be placed on a payment schedule that would satisfy a trustee of the court. So is there a new law on the books in recent years that allows for a discharge of MV surcharges in full without repayment?

Has the Drug Recognition Expert (DRE) Program for DWI cases gained judicial notice or passed the FRYE standard in NJ?
Has Drug Recognition Expert (DRE) or Drug Evaluation Classification (DEC) Program gained judicial notice or passed the FRYE standard in NJ? I know the program is not readily accepted in the scientific community yet but I constantly see DRE's in court testifying to being experts without challenge or objection from defense counsel. Is there any case law pertaining to DRE's or drug intoxication in NJ other than State v. Bealor (which only deals with marijuana intoxication)? How are prosecutors being allowed to introduce DRE testimony at trial in their direct case against the defendant without challenge? Please explain.

I received a check for "Prorated Amt Pd Payment TL Ret Salv". from the insurer of a drunk driver that totalled my parked car
Check is payable to me. My insurer already paid my underinsured motorist claim a few months. A drunk driver with $5K of liability totalled two cars and damaged a third in the middle of the night while they were parked on the street. Total loss. No injuries. The check I just received from the drunk driver's insurer came with a doc entitled "Full Release of all Claims and Demands Property Damage" signed by a claims rep at my insurer accepting the payment on my behalf and "release, acquit and forever discharge" the driver from all claims, actions etc . It's under $3K. I could certainly use the money and would love to keep it, but, do I need to reimburse my insurer for the underinsured motorist claim or pay anyone else? Could this be my share of a salvage and auction?
The easiest way to find out is to call the adjuster that sent you the check. Just ask them to clarify what it covers....

Ex wife arrested for DUI in NJ. I got the call at 2am to get her (amicable separation). She was sitting in the drivers seat, vehicle in park but running (was cold and running heat), talking with a co-worker in front of his house. Police approached claiming they received a call that she was flashing her lights. Initial questioning seemed to be out of concern for her safety (that maybe he was attacking her). Had her step out, seemingly to move her away from him to ask further questions. Then asked if she was drinking which she answered truthfully. From there the situation changed to an aggressive arrest, back to station, mirandized, Alcotest, etc. Ticked with DUI and Reckless Driving. She is 46, zero moving violations ever, full time employed and on town Fire Department as an EMT. Arrest occurred in different town than residence.

Hello, I was charged with a DWI this past Dec after leaving a holiday party in Roselle, NJ. The police officer was waiting outside the bar and I didn't notice he was there so I decided to move my car to my jobs parking lot that is less than a mile away from the bar so it would get towed. The officer followed me around and saw me slightly touching the yellow line which gave him probable cause to stop me. Long story short I did the sobriety test but I obviously failed, therefore, I was arrested. My BAC was .20 , which I know is very high , however, that day I took some advil pill so I don't know if this affected my blood? I usually don't drink and I just got carried away because I wanted to be merry with my co-workers and boss. Is it possible to work something out with the persecutor in order to be consider a tier 1? I just want my license to be suspended for 90 days. PS. this is my first offense and no one got hurt.
