I was recently arrested and charged with: DWI ( .14 BAC), Aggravated Unlicensed Operation Third Degree ( My license was suspended for an insurance lapse of 168 days), and Speeding (45 in a 30). This is my first offense, I have a clean record. I spoke with a local lawyer and he said that because my BAC was over .12 the DA would not give me a plea deal outright. He also said that it IS still possible to get a plea deal, it will just be more difficult. Is there any way that the DWI charge could be dropped or reduced? Is probation mandatory for those convicted of a DWI? Could I serve a short jail sentence instead of probation? What are my options?

I have received four violations for drinking and driving in NYS. The first three convictions are a DWI in 96, another in 97, a fatal accident DWAI in 2001, and have just been sentenced in Aug for a DWI which occurred in Aug of 2011. I received a letter in August from the DMV stating "You are eligible for the DDP. You will be eligible for a post-revocation conditional license/privilege when the revocation period ends." My question is; since, technically, it is treated as a first offense, why can I not get a conditional license prior to the post-revocation period, since it says I am eligible for the DDP - and I thought that was the whole point of the DDP; and will there really ever be a post-revocation period or does "revoked ... for at least 6 months" mean forever under Charlotte's Law?

I just would like to know what is going to happen with my NYS drivers license since I got a DUI in Rhode Island while on vacation. I have already served the suspension period for my license in RI. i just took a plea from the DA at central islip court for 1 year interim probation and pleading to a dwi. I have been told both that i will be eligible for a conditional after the dmv gets report of the conviction and i have been told that i am not because interim probation is not actually a charge. I would like to know the answer as my current attorney is impossible to get a hold of on this matter.

I have a friend who was involved in a DUI arrest last night and I am wondering what legal implications he may face if convicted. He is a college student and made some very serious/idiotic mistakes. I was convicted of DWI back in January 2011. Part of that sentence was a a 6-month jail term and a 1-year conditional discharge. The conditional discharge was set to expire on January 4th, 2012. I went to pick up my license from the DMV yesterday (January 14th) and was told I still needed an interlock device, however, with nobody to monitor it (courts or probation) all interlock companies I tried to schedule installation with claimed that they cannot install a device. Is this a DMV issue or does this have to involve the courts now?
