Can a DNR officer use a conversation requested to remain private and confirmed as such in a police report?
My husband was pulled over for boating for a DUI. He blew a 0.0 in Queen Anne's County but was taken to the sherriffs office to take a blood test. When the officer boarded his boat I was not there and called my husband to check on him. The officer requested to speak with me and I told him that I will not and cannot say anything that will be recorded or public so nothing in writing because he will pursue it in discovery. The officer lied to me and put everything said during our conversation he promised was private in the police report that is very serious. The details were not relative to why he pulled him over but gave a brief history of his issues. What can I do? It's already in discovery and it creating a nightmare. Court isn't until September and we are in the middle of divorce issues. How can he lie like that and what can I do about it?
There is no "private" or "off-the-record" when talking to law enforcement, an agent of the Government. Court cases...
Should I add my DWI to my answer for petition for child custody writ of summons?
Hello, my ex husband is trying to take me to court for child custody. We share joint legal custody but I have had primary physical custody of both children since our absolute divorce in 2013 leaving him with reasonable visitation with the kids. I've never experienced this problem before with him untiI recently because of his new wife. He has no real relationship with the children and hasnt seen them in about 3 years. I have a prior DWI charge from 2 years ago and his and his lawyer are trying to get me to submit to a hair follicle test? In my answer to the petition should I put that DWI since I'm being accused of drugs and alcohol present day but I am not just to be honest. I've completed 1 year probation, AA meetings and have been clean with no other violations on my record except that one incident? He is trying to use this against me as amo since he doesn't have any other valid evidence. Please help, Thank You
Since he has a lawyer, you need a lawyer. There are more issues to consider than what you have posed.
Can my record be expunged in Maryland after 2 Dui's in 6 weeks? Both car accidents. They happened in 2007.
The first one unfortunately my daughter was in the car. I had a alcohol induced seizure and hit a stop sign. Thankfully she was not hurt. My BAL was .43 So off to rehab I went. After I got out the guilt of the car accident with my daughter nearly destroyed me. I was back to drinking and flipped my car on a major highway .. My BAL WAS .29. I went head first through the windshield and was helicoptered to the hospital with head injuries and spent time in ICU. I got 5 weekends for the first but I only had to do 4. The second was in another county. He was going to throw the book at me, but only gave me 20 days which I did 17 total. He originally gave me weekends, but I wanted straight time. My drinking didn't start until 30, after a ugly divorce. I've been to rehab 3x in 3 years. 7 yrs sober

I just received my first dui in Maryland. I didn't submit a Breathalyzer but failed field sobriety tests. Can this case be won?
I was pulling onto my street and there was a deputy in front of my driveway. My wife called 911 because she slipped and fell but hung up.they sent an officer to check on the house so thats why he was there. I drove up and he asked who i was. I told him and he ran my license. Then he moved and I parked in my driveway. We all entered my house and he walked through the upstairs and downstairs and deemed the house ok that no problems were there. Then he asked me outside and asked me to perform field sobriety tests. I failed according to him. He asked me for a Breathalyzer and I refused. He charged me with D.U.I. and D.U.I. pro Se. Can this case be won?
Cases can be won depending on a multitude of facts that you haven't, and shouldn't, provide online. An experienced...
I had a totally clean record. recently i was pulled over, arrested, then not convicted and given a PBJ.
i am currently on probation in the state of maryland and this all happened in maryland. i just got a reallllly good job offer with a state college. they say on my first day I will be completing just a criminal history background check. on the application it only asked if I have ever been convicted of a crime so of course I answered no as advised by my attorney. Everyone seems to be telling me different things. but my question is when my employeer does this check will they see the arrest? since i was not convicted and even if they do does an arrest really mean anything since i have not been convicted. In addition, on the maryland state judiciary record public record search under my name it pulls it up as a traffic violation. will even see anything? if so do u think it will matte
This question comes up quite a bit. My answer is, it is always best to error on the side of honesty and full...
