I was the passenger in my car and the person driving said I had been driving earlier I hadn't. I got arrested too.
We both had been drinking, but the person driving had a suspended license. I think she aS trying to cover her butt by saying she HAD to drive because I wasn't able to. I also git arrested and charged. How can I fight this? I didn't know a police officer could use someone's oral stAtement as evidence to arrest someone when there is no proof that I drive that car. What should I do?
I am not licensed in Vermont, but the issue is something I have seen in CA more than once. First of all, in Vermont,...
What is the easiest way to get my license back?
I had a DUI in NH, which i live in VT, and it was 3 yrs ago. I didn't handle my case properly and got convicted. My BF is disabled and needs me to bring him to his doctors appt and other things he needs as well. I have a different lifestyle than 3 yrs ago I don't get in trouble (arrested, ticketed etc.) I don't drink anymore. I don't think that i would get anything out of the programs, I don't live my life like that and well aware of the problems it might cause for whoever is involved. Not only for DWI fees but also the fact of what alcohol does to the body and mind. I was wondering if there was a faster way to get my license back?
First and foremost, talk to your attorney from your New Hampshire DUI. I assume your license is in Vermont. There is...
Vehicle ran out of gas. Hazard lights on, keys in pocket. 1 hr passed making calls for assistance. I was arrested for a DUI.
While on the side of the road I had started to drink. An hour had passed when an Officer pulled up to assist me. He smelled alcohol on my breath, he said he would take me to get a can of gas. Officer told me before he was to take me to get the gas he asked if I would take a breathalyzer test. I reluctantly took the test and failed. I had told the officer I had been drinking during the hr I was on the side of the road making calls. I was arrested for a DUI I was not driving and vehicle was not running and safely parked on the side of the freeway. Is there a defence?
Yes there is no observation of operation - no probable cause - no observation if intoxication. This case screams "take...
Does vt require an iid for dui 3 offenders that have completed their crash reqirements?
Today I had my exit interview for project crash in springfield vt. At the conclusion of the interview, the person interviewing me told me that the state of vermont requires me to get an interlock device installed on my vehicle and that I would have to have it for life. I am trying to discern whether or not this is true. The program I did for crash was the total abstinence program, and all my paperwork was in order. In vermont the paperwork is then forwarded to the vermont DMV who conducts an investigation to decide whether or not I get my licence back. So far my research has told me that the IID is optional and I can wait until DMV makes their decision. However, my interviewer told me that to get my licence back, I would have to get and keep the IID for life.
Your lawyer would be in the best position to answer this query
Caught underage drinking but no citation given -- what next?
So I was at a high school graduation party and was caught drinking by the police. I gave them my name and date of birth and took a breathalyzer test (blew a 0.079). The officers said that I could go through the court diversion process and they would give me paperwork before I left. They stayed with me until my ride came, but they never gave me any paperwork or said what they were going to do with me. Now I'm wondering what to do next; should I do nothing and wait or is there a way to find out if I have a citation/am in trouble? Thanks
If the officer purposely did not give you paperwork, it might be because he forgot but is still filing it with the...
Visiting VT from CA with a Non-Updated DUI License
I am visiting some family in Vermont. The story is I got a DUI a year ago. Completed all court and DMV requirements to be reinstated. When it came time to remove the interlock, I went to the DMV to update my license. Well they botched it and sent me the restricted license. The CA DMV appointments are so backed up, I am months away from changing this, but was informed by the DMV that it is not a problem because my updated status is in the National Registry. In fact I've been pulled over once in CA during this period and the officer confirmed I am okay to drive. Now my question is, can I drive in Vermont? Do officers have access to the national registry?
I am not licensed to practice in Vermont, so out of respect for any local experienced attorney from Vermont, refer to...
Can Bob claim he was voluntary intoxicated if he went to court or would he be charged with disorderly conduct?
Bob and Jon are walking home from a hard night of partying at a local drinking establishment. bob is very intoxicated, swaying as he walks, and Jon isn't much better off. As they walk home, they pass Mike coming the other way- Mike is a gamer and wears gamer association t-shirts. Bob and Jon both find this entertaining, and Bob begins openly mocking Mike about his t-shirt. Mike takes offense to this, shouts at the two to leave him alone and attempts to walk past the two with his hands in his pockets. Jon shouts "hit him, Bob" and Bob strikes Mike in the nose with a closed fist, breaking Mike nose. Bob and Jon stand there congratulating each other drunkenly.
Bob is guilty of breaking a guy's nose. The fact that he drank before striking Mike does not excuse him from the act,...
