Can I take legal action against my lawyer?
Please help- I was arrested about a 1.5 years ago for DUI (I did not blow or give a blood sample). I had another person's prescription for pain pills and was charged with a felony. I hired a lawyer and paid him $2500 to represent me.I went to court three times for the felony and he never showed up. Eventually the charges were dropped due to the evidence (the pills) being "lost" and the cop not showing up. Now I must go to court this Monday to face the DUI charge and my lawyers secretary informed me that my lawyer had more important cases to work on and will not be coming. What was the money spent on and can I sue to get it back? It seems as he, the lawyer, robbed me. Now I must find a new lawyer who is not familiar with the case. Is there any recourse I can take?
You can certainly attempt to sue your attorney. Additionally, you could start by contacting your state bar, they...

DUI charge without implied consent, breathalyzer, or field sobriety tests
My husband was pulled over after an officer attempted to pass him. The officer stated my husband almost hit his patrol car as he passed him. My husband was asked to exit the vehicle. He was given only the eye test. The standing/walking test was not given. The officer arrested him stating he failed the eye test and had blood shot eyes. He never read the implied consent, Miranda, and was never offered any breathalyzer or chemical tests. Can we independently request a dismissal in his case based on these facts?
You will be better off to immediately hire an attorney. Many of us on Avvo give free consults. If what you say is...
Server's potential liability for serving alcohol to drunk individual.
I work in a restaurant and thought I'm not supposed to serve intoxicated individuals. Last week I served four hard liquor drinks to a person and they wanted fifth. On the fourth I began to question how they were, but went ahead. As part of the conversation with I casually got at if they were driving and he was. When they ordered the fifth I talked to my manager and told him I did not want to serve another and he told me to serve. I tried to get him to serve it, but he wouldn't. A sixth was ordered and again I went to my manager with the same result. Two days ago a Marietta officer came to the restaurant and questioned me. I told the above, but my manager lied and said I never went to him. The driver was in a car accident with injuries. Yesterday a person came in and asked me questions that said they worked for the attorney of the guy that I served. Am I in trouble? Do I need an attorney?
Under Georgia's Dram Shop laws, the victim can bring a lawsuit against the server and owner of the bar. The purpose of...
Ignition Interlock Waiver for DUI from 8 Years ago.
Long story short: Back in 2008, in Georgia, I had a 2nd in 5 DUI (and totaled my vehicle) after which I served jail time, paid hefty fines, had to take several classes and satisfy other requirements for my probation. Shortly after completing those requirements and finishing probation, I moved from Georgia, to Chicago, Illinois and have lived here ever since. One of the conditions for reinstating my license was to have ignition interlock for 6 months. Problem is that I don't have a vehicle, and can't purchase or finance one without a license. I can't get an Illinois license without my Georgia license reinstatement fee paid and that requirement for ignition interlock satisfied. I'm at a loss of how to proceed and would like someone experienced with waivers and the process involved so that I can a) take care of making Georgia happy, and b) getting a drivers license. I haven't drank since my accident in 2008, have a great career, and haven't been in any legal trouble since that stupid decision I made over 8 years ago. I live in Chicago and really don't want to purchase a vehicle, but still would like to rent a car or moving truck from time to time and need advice.
All you have to do is get an ignition interlock device waiver. Do you remember which court your case was in, or who the...
