My sister was arrested for a DUI after passing all the field tests. Breath test given later confirmed DUI. Can it be dismissed?
My sister was pulled over for running a toll. In conversation she admitted that she had a drink about 2 hours prior. She did 3 field tests, passed 2 of them and on the 3rd test, it was noted in the report that she had difficulty walking the line because while standing outside the vehicle she was stung by something that made her foot swell twice its normal size. She was unable to stand on the leg much less walk. The cop arrested her anyway. Once she was taken back to the station another cop did the breath test which showed a .13. Since she passed the field tests and the cop noted there was NO smell of alcohol on her breath or impairment (except the white line test), does she have a chance of having the case thrown out for lack of evidence? Or can the breath test be thrown out?
DUI's are time sensitive in that you only have ten (10) days to challenge the suspension of your driving privilege....
I refused a blow test and was issued a ticket my license was suppose to be suspended never was, this was 2 1/2 years ago I was from SC, The ticket was lost by the court system and a case was never filed and I was never charged or arrested. But the ticket info was relayed to the DMV. Now I move to FL and try to get my license changed to FL they (dmv) tell me I need to enroll in a DUI classed or have a cert of completion. My question is how can I get this removed from DMV system since there was never a suspension or a criminal case or dui case and I was not arrested. It is now past the time they can prosecute. Is there a way to have it removed so I can get my FL DL ?

Would it be worth expunging a DUI after it was dismissed? I am 22 years old and just wrapped up the entire DUI process
After receiving my DUI in a couple of years ago, I was admitted into the pre trial diversion program of the state of FL and successfully completed all aspects of it. My DUI case was officially dismissed and closed. Given that I am 22 and I am just beginning my professional career, I was wondering if expunging my record of the DUI right would be worth it. Given that you can only expunge or seal one thing ever. Would it be worth doing it this early in my career or would it not really make a difference when It comes to employment since you nevertheless really know what may happen in the future?

2nd offense, just never appeared for court date for the DUI incident. Been out of the US for around 5 years, got issued a warrant for failure to appear in court. They have been a US resident with home & job for 25+ years but I don't believe they ever attained citizenship.

I was arrested In Orlando, Florida for DUI in November 2013 and subsequently placed on the PTD Diversion Program. I relocated out of Florida due to long term job loss and financial issues. Unfortunately I ran into a subsequent (non alcohol) event that caused me to be released from the PTD program. The state where the subsequent event took place was never prosecuted and the charge was dropped. I recently received a letter from the FL Judge requesting a status conference very soon. Because I just started a new job and having no income (unemployment was denied) for the past several months this definitely makes getting to FL a stretch at best. I am not trying to run from the situation just asking for a little additional time in order to make the trip. PD not returning calls or emails
