Is there a way to fight the DMV's decision to issue a conditional license?
I was charged with a DWI in 2007, but only recently convicted in January of this year. during this time i had a conditional, but it was taken away due to riding an uninsured dirtbike on the block adjacent to mine. The suspension time for the no insurance has long since cleared but when i talked to the DMV they said they cant "clear" my license because of the open DWI. Im a full-time student and was a full-time worker now part-time and afraid of losing my job because of having no license and needing rides, let alone getting to school. I wanted to know if theres anyway to fight this decision and restore a conditional license.
You should consult with the attorney who represented you on the DWI.
3 ALOCHOL offense in ny will revoke me for ten years. Does that apply if i move to Ga. After i finish my court sentence?
Basically after i finish my revocation with the courts... can the 10 yr NY dmv band affect me moving out to Georgia to get a license?
The Georgia motor vehicle commission will likely ask you in an application whether you have a suspension in any other...
Are there previous examples of prescriptions such as Adderall effecting field sobriety tests?
I received a DWI based on the officer's observations of a field sobriety test that included a (1) the horizontal gaze test while in the automobile, (2) a walk and turn test, (3) the horizontal gaze test outside the automobile, and (4) an onsite breathalyzer (.129). I refused the chemical test and have a refusal hearing with the DMV regarding my suspended license. Is there any examples where prescriptions such as adderall have been found to effect the outcome of either the horizontal gaze test and/or Breathalyzer?
It doesn't matter if it affects the breathalyzer since you refused it. The onsite breathalzyer you described is not...
Question about probable cause on a DWI?
I unfortunately was arrested for a DWI. I was followed late at night, by an off duty cop who was driving his own personal vehicle, a Jeep, with off road auxiliary lights on super high. He followed me all the way to my home. I felt extremely scared and didn't know who he was. He also was tailgating me extremely close. My security camera at my home captured him doing this. He apparently made a call (I don't know to whom as I never recd the reports or if there was a 911 call) and I subsequently was arrested for DWI by another cop. I wanted to find out if this would still constitute probable cause? He claimed that I was driving erratic, which I was definitely was because I was frightened out of my mind. I am female and live alone. He never identified himself so I was terrified. Thank you.
i would have to read the complaint. If it says that the arresting officer was informed by the other off duty cop that...

Husband has a DWI accident n my name is Not on the registration but IS on the car insurance can I be sued?
I want to clarify my prior question from this morning. My concern is that my husband will get into a car accident for DWI n be sued but because both our names is on the House Deed and Car Insurance and Savings Account that I can be sued too. My name is NOT on the car registration, does that make a difference? Before something like this happens, is there a Legal Document I can have him sign releasing me from any responsibility for his actions?
Best bet is to get a big insurance policy, and look into an umbrella policy.
If my husband gets into a car accident for DWI and he is sued, am I his wife, affected as well?
I'm concerned that everything I worked for (my home) can be taken away by a lawsuit that I have no fault in. If so, is there anything I can do to protect myself n children to prevent losing my savings, assets, etc. if such a lawsuit would take place? Is there a legal document that my husband can sign releasing me from any responsibility for his actions?
Most importantly, notify your insurance carriers (auto, home) asap. If you are named on the title/registration you...
