What happens at the end of probation?
I am finishing up 9 months probation. I have weekly etg and drug screens and have been on non reporting for 2 months. My probation is scheduled to end in a couple weeks. I was told I would receive a letter in the mail. Any idea if I will have to go back to court, or get a release or something, or will the letter just tell me I'm done? Is it usually exactly 9 months from the first day of probation, ex Jan 1st to Sept 1, or is it an estimate and can go longer or til the, end,of the month? Just wondering because I may be going or of town for work the next week and will need to change my plans or get exemption for travel if this is the case.
Call your probation officer and seek the answers to your questions. Sometimes courts send you a notice that your...
Does Ohio recognize a Michigan Restricted Drivers Licence when in total compliance with Court Restrictions due to a DUI?
I live in Southeast Michigan and there are two AA meetings I used to attend, that I really liked in Toledo 4 miles and 5 miles respectively south into Ohio from Michigan. Does Ohio recognize a Michigan Restricted License en route to and from these meetings should I go to them? I tried calling the Michigan SOS.... they didn't know and I can't find an answer after an extensive Internet search Thank you
Probably but why not call te Ohio Secretary of State?
Can a person sue a banquet hall for over serving them if the patron left and was injured in a drunk driving accident ?
My son was the DJ a his friend's wedding and was over served. He has no memory of the end of the night and he was caught on camera walking off with $150 in silverware from the hall. That was reported to the police and they have turned it over to the prosecutor for charges. He drove away and was involved in a roll over single car accident that resulted in a severe knee injury. There is a chance he will never regain full mobility. His BAC was .12. Does the hall have any liability for over serving a drunk person and can he sue them? Can the charges of theft can be dropped by the hall owner or is that impossible once it has gone to the prosecutor? Perhaps he could send a letter to the hall offering restitution and saying he will not sue them if they drop the theft charges?
Does your son bear any personal responsibility for the fact that he chose to drink and he chose to drive? Although a...
My original DUI attorney (3rd offense) was paid 10,000 upfront. He withdrew from my case and abandoned me. Anything I can do?
I hired an attorney in 2008 to the tune of 20,000. He was paid 10,000 upfront by my mom and appeared 3 times to court. I had a hard time paying the balance and he went behind my back and motion to withdraw from my case. I did not know about the court date until after the fact by email that "he had withdrew and there was a bench warrant out for my arrest" I had an excellent case with some errors and loopholes. I was abandoned without proper legal representation. I was given a court appointed attorney and my case fell apart. Lack of proper information and guidance etc I was left between a rock and a hard place. Now 4 yrs later......upon reflection this does not sit right with me as my medical career is essentially ruined. he kept my 10.000. Any recourse?
It's doubtful you have any recourse. The lawyer is a) entitled to a fee for his work, and b) provided he follows the...
Can a dui conviction (3rd offense) ever be overturned or reduced to recklass driving etc way after the fact?
I was convicted of dui 3rd offense in May 2009. The incident happened Sept 20, 2007 and I was not charged for this until July 2008. There was a blood test that was supposedly taken (and I paid for) and the original police report was changed or destroyed. My lawyer dropped me in the middle of my case without my knowledge due to lake of payment (paid 10,000 up front and owed 10,000). i went into a serious depression and had a court appointed attorney that suggested I take a plea deal. i took plea deal despite all the inconsistencies of the case because I had no lawyer that was fighting for me with my interest at heart. I completed my sentence, paid my fines, completed 18 months of probation successfully. The felony conviction is ruininng my opportunities. Anything can be done now?
You can hire a lawyer to file a motion for relief from judgment. This is an uphill battle, but it may be your only...
How long for Dui blood test results, pt. 2.
Six months ago, I posted this question, http://www.avvo.com/legal-answers/how-long-for-dui-blood-test-results-in-michigan--638832.html on this website regarding the length of time for blood test results from a dui detainment to come in. At that time, despite having blown a .05, I was still taken to a hospital for a blood draw, booked, finger printed and released without formal charges. Two weeks ago, I received a an evelope from the police department returning my driver's lic. and stating that my blood test results had come in .04, with no presence of drugs(not surpring, as I don't take any at all, not even prescription pharmaceuticals). Yesterday however, I got a summons stating I had been charged with an OWVI, 13 months after the daetainment. I am looking to hire an attorney
If the prosecuting agency is charging you with Operating While Visibly Impaired (OWVI), then you need to speak with a...
Will I receive jail time for not completing community service on time?
I received a DUI in November of 2010. I was sentenced to 6 months non-reporting probation, holiday alcohol testing, alcohol counseling, and 40 hours of community service. I have completed the rest of my probation and paid all fines in a timely manner. I have attempted to complete my community service, but I have a very eratic work schedule and not one agency I have contacted has called me back. I have a great job and can not do jail time and keep it as well. Will I receive jail time or are there any other appropriate actions that the court may take?
You need to contact an attorney immediately. I do no practice in your jurisdiction, however , in most states you could...
