hi dave hear,got stopped a yr and a hf ago and charged with dui,went to court with a court appt attyy,and court case got threw out,then got a letter from dmv(wv here) ,stating they were gonna try and mess with my drivers license,and dmv said dosent matter that the court case was dismissed, but prior to it being dismissed I contacted an atty in charleston,and they told me it would be 2500 depending on how the court case went,well it got threw out with the public defender I had,and its been 1 1/2 yrs and I asked the atty I hired for a partial refund on the 2500 I gave them, as Ive heard nothing else from the dmv and I truly wasnt under the influence(gave blood) and the atty sid he would check into it 2 weeks ago,and ive left message at there firm ,and online talking to him ,now there simply not responding,am I not entitled to a partial refund

I got stopped for expired tag, i didnt drive faulty and obeyed all traffic laws, officer noticed that i had slurred speech and saw bruises all over my body and mud. also noticed that i couldn't follow directions he asked me to do hgn test 6/6 cues then did walk and turn 8/8 cues and 4/4 cues on one leg stand there was a small rain shower while the tests was performed i am prescribed glasses but wasn't wearing them that day i stumbled several times while being placed under arrest and made strange comments at times when i got to the station an ems drew my blood which tested positive for phenazepam and mitragynine the exact concentration of the drugs was not provided. can the government provide this state beyond a reasonable doubt in your opinion?

I was driving for work (class A truck) and went through a yellow light that turned red. When the officer pulled me over he immediately asked if I had been drinking. Which I denied and explained that I was returning from Michigan. He did a field sobriety test and said I was "wobbly" on one leg which I explained I had been driving 10 hrs. I had a negative breathalyzer and he arrested me anyways, impounded the truck and was held without bond 17 hours. I demanded a blood test. I am now out on PR awaiting trial for a DUI. How is this legal and how do I proceed? What's the likelyhood of this being thrown out and can I counter sue? Since I cannot work until this is cleared up.
When you say the breathalyzer test was negative, what do you mean? Was it 0.0%? Did you give a urine sample for drugs?...
If first time aggravated dui plead down in court to non aggravated will WV DMV reduce requirements to reinstate license?
Case was over a year ago and moved out of state shortly after. Do not plan on moving back to WV but feel I'd have to for the 9 month ignition interlock. If case was plead down in court will DMV hear the case?

I was not stopped was sitting in my car in a parking lot waiting on a ride as my tire hit the cement median and popped. I only knew from tv/movies that many tests are not designed for certain sexes,age range, hormone flucatuations and that breathalizers are almost 70% inaccurrate as are the other types of tests.
You may need to subpoena those videos, if they are available.
Am I required to show proof of insurance to get my license back after 11 years?
I was pulled over while intoxicated in 2004. I was driving someone else's vehicle. I was charged with no proof of insurance, no inspection sticker, not having my seat belt on and no license. No charges on the intoxication were ever issued. I never went to court just surrendered my license. I have not tried to get my license back in those 11 years. I am my mothers caretaker. She is getting on in years with many medical problems. I don't know how much longer she will be able to drive so I need to get my license back so I can take care of her. The people at the court house are telling me I may go to jail if I don't show proof of insurance. This is impossible after so much time has elapsed and it wasn't even my vehicle.
