Can I become a Licensed Masters Social Worker in Texas with a DWI
Long story short I made an error of judgement one night and was charged with a DWI, which resulted in a conviction. I currently work with the VA and want to move into a social worker position, which in turn requires me to go back to school for my Masters in Social Work. My question is will this single class b conviction bar me from obtaining the required license for this profession.
You need to consult the criteria/disqualifiers which are likely posted on the licensing board's website. Most...
Red light camera evidence for DUI motion
Hello Law experts I got a 2nd DUI and the cop claims he pulled me over coz i stopped after the white line when the light is red. There was a red light camera at the intersection towards my directions and i was able to get a business records from the red light camera company saying there was no video capture or citation issued for me, I was also able to get maintenance records saying the camera was working at that time. Can i file a motion to dismiss my case? Thanks for your response KS
You can file a motion to dismiss, but it will get laughed out of the courtroom. The only requirement is that the state...
Probable Cause and motion to supress
As some on here may know I recently had a DWI back in april. The reason why the cop pulled me over is because i didn't do a turn signal at least 100 ft before two turns I made to park in front of my house. However, I was able to prove with a measuring wheel that on the first turn it was only 86 ft to make a turn signal so there's no way I can do a signal at 100 ft. The second turn it showed on the video I did it right at the speed limit sign or a little after. The distance measured was 116 ft for that turn. However, in the ALR case the judge deemed the videos to instead support the officers claim which didn't really make sense. Currently appealing the decision. However, I've been advised that due to probable cause, an officer at the time of the situation can stop your vehicle and that since I lost my ALR I can't do a motion to suppress in the criminal case. Apparently, I am now facing an upcoming plea bargain that I don't know even though the officer saying in his affidavit that it was an improper stop as well. Sorry but the judicial system really has some quirks if this can be allowed.
Is this a question? You must have a lawyer. You need to discuss this with your lawyer. Just because you lost at the...
How much actual jail time in 2nd DWI?
DWI -Second. If offered probation thru plea bargain, how much actual jail time? I have work during the week. Is there work-release or other ways to serve jail time?
DWI 2nd is a Class A misdemeanor for which one could receive up to 1 year in jail and up to a $4,000 fine. One can...
Can a lab technician at a blood lab give your results over the phone?
I recently am waiting on my blood results to come back from the blood lab in the north Texas area. I called to see if maybe I can get an update on my blood result and I was told it was done and sent to Denton PD on July 23. The lady then told me my blood result. I never once identified myself. My blood result was below .08 but I'm wondering now since that was a breach of confidentiality will the whole test be thrown away now?
The specific answer will come from your attorney in your criminal case but it seems rather odd. a breach of...
Would I need to do an ALR hearing if I gave blood due to a warrant and it's below .08?
During waiting on my trial on my first DWI 2 months after I worked a 12 hour shift and after work me and a friend went to a bar to drink. Only drank 2 standard drinks. This was from 11 to 130 at night. I then dropped him at home and then started driving home. I realized I was falling asleep so I pulled over into a parking lot and went to sleep in park. Next thing I know it's 330 and I'm being awaken by a firefighter tapping on my car door who was checking if I was ok. A cop then came next and asked if I drank anything. I was honest and said 2. I then said A to Z, C to W, and 52 to 23 backwards correctly. He tried to get me to do the nystagmus test but I said no to field sobriety tests after my experience with the first one. He then said blood but I also declined. He then took me to jail and went to get a warrant. He didn't get me for a blood test till 8 in the morning though. My question is though since there's no video of me driving (the police car wasn't parked near mine so there's no dashcam) and since I'm waiting on a blood test that will be way below the limit will the ALR hearing suspend my license if waiting on a warranted blood test?
Yes, you need to request an ALR hearing because you refused to give a sample of your blood, when asked to do so by the...

If your probation officer doesn't have a problem, then you don't have a problem. Do whatever the PO tells you to do....
