The breathalyzer errored. Is it worth challenging?
I'm a DUI first-time offender. When I blew in the breathalyzer the first time, it errored. The person administering it even said that he'd never seen it do that before. After that, I blew an additional two times. I was told by another officer at the impound that it wasn't worth fighting the results since they did it an additional two times. This might be on my video taken at the station, but I'm not sure if it has audio. Would this be worth investigating, and how would you investigate the validity of a breath test?

Possible DUI due to Kolonopin
Hello. My grandmother passed away a few days ago and my aunt gave me a little yellow pill called Kolonopin just in case I needed it for panic attack/anxiety (it runs in the family). I took the pill before bedtime as I was anxious and could not sleep and slept well, but didn't feel groggy at all when it came to take my daughter to school. On the trip, I dodged a large rock in the road and ended up in a ditch. The police asked me to take a blood test to which I complied as I had told them what I had taken the night before. Can I be charged with DUI not knowing I wasn't supposed to be driving on this medication?

My friend was arrested for driving on a revoked for a DUI in Tennessee. Her court appointed attorney said she should take the first offer from the DA, which includes jail time. I had a lawyer a few years ago who did NOT take the first offer and I got a better deal in my DUI case. But this is a driving on a revoked case. Plus, to take the first offer also means she will be put on PSI probation, a private company that tries to keep you coming back as long as possible. When I took my case upstairs, I was allowed to be put on state probation, which is much better and not as rigid or rule-crazy. Should she say no to the first offer and get the case taken upstairs? Is that possible in a driving on revoked case?

My children go in trouble repeatedly and all my money went to the courts for them and this also cost me my job. I was told by my lawyer we had a good case and it could possibly get dropped. Now he's telling me that I will lose my license anyways because I didn't take the blood test. Why did he not tell me this when we went to court the first time? Now he wants full payment before I go to court which is the 30th of this month. I don't have the means to give him 2000. more after already giving him 2500. the first time. I have never been in trouble before. What do I do? Do I just represent myself?

Can Amelia's Law be used for a suspended sentence for a first-time DUI offender in Tennessee?
I wanted some clarification on Amelia's Law as it pertains to suspended prosecutions for DUIs. I understand that according to the Tennessee Code Annotated Section 40-15-105 DUIs are prohibited from suspended prosecution. But, with the introduction of Amelia's Law in Tennessee Code Annotated, Section 40-15-105(a)(2), are suspended prosecution offered to first-time offenders of DUIs if they agree to the transdermal patch? I suppose I'm confused by the statement "...the defendant use a transdermal monitoring device or other alternative monitoring device if, in the opinion of the district attorney general, the defendant's use of alcohol or drugs was a contributing factor in the defendant's unlawful conduct" when the section before it states that DUIs are prohibited.
