I have had some serious problems in the last few months as I have been arrested twice for DUI, once in Del and one Chester County, PA. Leaving aside my terrible judgement during these 2 incidents, I am curious as to how the DUI's will be treated. Due to their closeness, my attorney believes they will both be treated as 1st DUI offenses, with the DMV recognizing that I do in fact have 2 DUI's on my record and treating it as such. More specifically, in your opinion, am I looking at a year suspension for the first offense and then an additional 18 months for the second as it was a 3rd tier, or will there be a different timeframe as they were so close together? The first arrest occurred in July, 2013 with the second occurring in September, 2013. I am curious as to how the DUI's will be treated. Due to their closeness, I've been told they will both be treated as 1st DUI offenses in both counties. My question arises from the fact that by the time of the trial/pre-trial hearing for my 2nd offense, I will have been convicted of the first DUI. I'm just worried that the court will see my conviction on my record, regardless of having committed the 2nd offense before being convicted for the 1st. Is this a valid concern or will they both, from a court penalty standpoint, be seen as 1st offenses?

So sunday before memorial day my friend kicked me out of his house after a night of drinking. I admit I was still pretty drunk but my now ex friend refused to let me sleep it off. After getting off a ramp I must have been going too fast because I spun, hit a guard rail and wrecked my car. No other people were hit or in the car with me. When cops arrived they said I smelled like alcohol still and took me to the hospital for a blood test. They did not check me for any injuries even though my car had been totaled. I have had no prior DUI's. I do have a record most recent was a disorderly conduct charge. Everything else is from years ago. I want to know how likely it will be for me to go to jail.
