Can I get a bogus felony 4 DUI not just 'set aside' but totally removed off my record after 12 years?
Twelve years ago, I was indicted by a Grand Jury and convicted for a Felony 4 Extreme DUI, sentenced to 3 years in prison. I had never been in trouble before. After my ex husband, a Lt. Sheriff retired and moved out of state, this detective arrived at my house with a search warrant, saying since he can't get his revenge on my ex, that I'd do, and arrested me for a pending DUI, not once, but 6 times. It was all so confusing to me. I tried to tell my appointed defense attorney that I was being set up, but he said, that I should just admit that I have a problem, and take this time to deal with it. After my release, I contacted the AZ MVD Investigations, the report concluded, through court records-found I had 1 Dismissed DUI from 1994. Also found 6 duplicated DUI's on my driving record, submitted within 6 months of each other, all were updates from the same 1994 dismissed DUI. He cleared my driving record and reinstated my drivers license. I waited 12 years because, upon my release, my attorney was now the Superior Court Judge, (retiring this year). No local attorney would touch this. I need justice, what can I do to get this off my record. It's been horrible.
Can you apply to set aside, maybe, but a lot of that depends on what you've been doing since your release. Challenging...
AZ DMV is putting a hold on my CA license.
About 3 yrs ago I got a DUI in AZ. The magistrate told me that since my license was from CA, do whatever CA DMV requires and that would satisfy the court. I did and now the AZ DMV demands that I install a interlock device in my car in order for them to release the hold on me CA license renewal. Is there any way that I can fight this? I completed everything that CA DMV required and submitted all info over to the AZ court and served a weekend in jail. I thought everything was complete until now. Please help
If you got a DUI in Arizona 3 years ago you would have been ordered to do the interlock. There is no exceptions to...
Court appt Attorney w/case overload burn out, settled on court recommended sentencing w/no defense, is now Superior Court Judge
I'm divorced from a Lt. Sheriff, 1995, who wronged fellow officers, and moved out of state. Soon after, I was arrested for a DUI, court dismissed it. Four months later I was presented w/an arrest warrant, stated reason:DUI ?? OR'd by morn. This happened 7 times w/in 6 months. My assigned defense attorney soon advised me I was indicted for EXTREME AGG DUI, that it was a done deal & I would do time. After 2 yrs in DOC, I went to renew my D.L., it was revoked. I contacted the MVD Investigations, who found 1 dismissed DUI on record - period! & 7 duplicated DUI's on my MVD record, which he corrected and reinstated my D.L. Problem has been, no attorney will touch my case & justify the false records, because, my then app t attorney became the Superior Court Judge before my release. ?????
I have some background, but no question.
What happens to my Arizona license after a DUI in Texas?
I have two DUI arrests in Illinois, but only one conviction. I recently moved to Arizona, and on the drive down, stopped in Texas for the night. While I was there I was arrested for DWI 2nd. I'm now in Arizona, I have an Arizona license and am registered. I just received Notice of Suspension from Texas giving me 45 days until I must send in my license. I haven't heard anything from my court appointed lawyer about a court date or anything. This suspension notice is just due to the fact that I didn't give a breath sample. So, I haven't been convicted yet as far as I know. Is Arizona notified about the process of my case? Am I supposed to send my AZ license in to TX? Does Arizona follow the suspensions and everything that Texas will convict me of? Shouldn't I get notice of suspension from Arizona as well?
The Texas court has personal jurisdiction over you, and Arizona has subject matter jurisdiction over your license. You...
Would a dui case be thrown out if inaccuracies are in the police report?
I passed out while driving. I ran over a stop sign and did a slow roll down the street ,where my truck met a block fence and was stopped. I was transported to theER via ambulance. The accident occurred very close to my house. My roommate walked to the site and was able to drive my truck to my house, then to the hospital to pick me up .I was never arrested or given a citation. Many months later, I was charged with a DUI. After finding this out, I saw, for the first time, an accident report. There were several inaccuracies regarding my truck. The most glaring one was that it was towed from the scene, even listing a tow company. The case is over now but, talking to other people that were accused of DUI, I've heard that those inaccuracies were enough to get the whole case dismissed. Is this true? I was represented by a court appointed legal defender. I tried to mention the discrepancies but was just brushed off and told it really had no bearing on my case. If it would have made a difference, what was the defenders legal obligation in telling me? Thank you, Mrs. D.
Discrepancies can be used by an attorney to raise doubt, not necessarily get the case dismissed. Your questions are...
How do I get my license reinstated following a suspension due to a DUI in 2008?
I paid all fines, served my 30 days in jail, and everything ordered by the court, and I am no longer on probation. Everything except the interlock device in my car. I am 66-years old, and I have COPD. I am unable to blow into the device strong enough to clear it or whatever it does. I have a clean driving record except for the DUI.
Unfortunately you will need to install an interlock on a vehicle and keep it there for the period of time required by...
I need a Vietnamese speaking lawyer for DUI
i have an employee that got a DUI back in March. he was given the standard test and passed. then 2 breath tests that they said were not working correctly. he was taken to the station and given 2 more breath tests that showed nothing. they then told him that they were taking his blood and that test showed from .15-.19 according to him paperwork. the fact that he did not understand what he was agreeing to is why I am seeking an attorney for him. Would that help him in any way?
Off hand, I do not know any Vietnamese-speaking attorneys practicing criminal defense and DUI law in the Phoenix...
