My nephew got his 3rd DWI driving my minivan, and my van is said to be forfeited, i am handicapped how do i get it back?
my Nephew was driving my van without a liceance (unknown to me) and got his 3rd DWI my van was impounded and told to be forfeited, its been two days and the arresting officer still has not gotten back to me on how to get van back. The deputy answering phone said they had to interview me about letting him use my vehicle, also mentioning i may get fined and may have to go to court in 30 days to try and get my van back. Now I desperately need my vehicle I am handicapped and have a major surgery coming up in days with quite a few dr. appts in these weeks between I have no one else that can take me, I live on a limited income and i am still paying for my vehicle i can not afford to get another and still pay for my van please i need help and dont know what to do.
That sucks, don't expect the police to help. You need a lawyer. The cops couldn't care less.
I was charged for felony DUI & Test refusal and was not the inital driver of my vehicle. The police reports are also conflicting
I was a passenger in my own vehicle when a citizen reported my car swaying in the lane. The driver turned into a McDonald's restaraunt and I took over the driver side to see the menu and order. Just then I looked in the rear view mirror and the red lights were on us. I was told to pull over to the side and me and the driver switched seats again. I was charged as the driver going all over the road and failed my field sobriety test. After reading the police reports from three separate officers, the reports have conflicting information about who was actually behind the wheel at the time of the stop. Also I was on seroquel which is a strong anti-pychotic medication. I did not do the intoxilizer. Does it sound like I may have a chance to fight this?
Although Avvo is an excellent resource, this question is far more complex than this cite is designed for. In Minnesota...

You have options for attempting to get a limited license if necessary (when isn't it necessary). You should continue to...
Can I work as a taxi driver if my DWI is expunged ?
The court in Minnesota has recently granted my petition for expungement of my very old DWI conviction. I am also aware that I will need to wait 60 days after the grant. However, I would like to know if I will be able to work for Uber ( taxi driver) after file is sealed ?!
That's going to be an internal matter for Uber to decide.
My dui citation isn't in the system? Did I actually get charged?
I recieved a citation for a dui December 3rd, 2016 (over two and a half months ago) and it is still not in the system. When I call in they say there's no record of it (so I also have no idea how much my fine is), and I have yet to receive my court date. I was with my boyfriend and he got an underage drinking ticket at the same time but that was in the system within 10 days. Is this long a normal time frame? Or did my ticket get lost or something? I would just like to know what exactly should I do in this situation, and if I'm actually going to get charged.
It's hard to say. It's possible that the prosecutor just hasn't filed the charges against you yet. Did they do a blood...
Why wasn't I informed about "no alcohol use or drug use" on back of my license?
Back in October, I was stopped and charged with DUI. I beat both the criminal and DMV hearing parts of it. The state of MN gave me my driving privileges back, so I thought everything was good to go. The other night I was in my truck coming back from the casino, and my friend was driving my truck (sober) and we got stopped and he ran our licenses. He came back to my window and said that I had a no alcohol or drug restriction on my license, and that he wasn't going to issue me a ticket or anything that night, but if he had to he would send it in the mail. I was never informed or agreed to in writing for the "B-card." I just looked it up out of curiosity, and I see that it says any violation of the "no drink, etc" results in immediate cancellation of my driving privileges. Is this true? I just don't see how if I never agreed or was informed about the restricted driver's license how I can get lose my privileges? Any help/feedback would be greatly appreciated. Thank you!
I had a similar case some years back. The DPS took the position that they cannot cancel and deny (B-Card issuance) if...
Can I be charged with DUI in my parking lot and hearsay?
Police were called to do a wellness check cause family thought I was driving while intoxicated, wasn't driving, but I was in my car smoking a cigarette and passed out, mind you I was at my apartment complex. Car was not on and keys fell between the center console and seat. When the police showed up, my sister in law was standing between the driver door and me and my foot was hanging out. Before then, they went to the wrong apartment complex, in the report they stated "drove through parking lot but could not locate vehicle". They did the field test on me, failed, and blew .23 and they arrest me for dui. My car is a push button start and they turned it on without my consent and they tore up my car trying to locate the keys. Took them awhile to find them, they had to literally dig through my whole vehicle to find them. The officer told my sister in law "because of what he blew, that is enough to charge him with a DUI". I don't know how to go about this and I feel I was not in the wrong. Now I fear just being in my car.
