Do I possibly have a lawsuit against Arkansas DHS?
My son was born in February of this year. The hospital where he was born said he was born with barbiturates and tri-cyclic antidepressants in his system. Under Arkansas Act 1176 (Garret's Law) DCFS was called. The hospital performed a meconium test to confirm the urine test but didnt test for barbiturates or antidepressants in the meconium. Therefore confirming nothing. Even though they couldnt confirm the positive test they proceeded with opening a case. I was drug tested weekly and passed every one. I had a substance abuse assessment performed and the results show that I am at no risk for substance abuse. My main problem is that I specifically asked the case worker if I needed to file an appeal for the sake of pursuing a career that would require a background check. She told me "No. My name would not show up on any registry and that the only reason I would need to file an appeal is for my own peace of mind." Now 3 or so months later I have applied for a job to be able to support my children and have been denied the job because the background check came back showing all this. Do I have any legal options?

Husband had shoulder surgery 5 weeks ago and was told to be off work for 12 weeks. I am the only source of income until he can go back to work and I am afraid I may lose my job as I am a seasonal worker and employment is just picking back up. Would a judge continue this matter until my husband can return to work? I'm not trying to avoid the jail time or plead not guilty, I just want to keep from losing everything in the meantime. Court is tomorrow and I have been appointed a public defender whom I've tried contacting a few times with no luck. Tomorrow will be the first time I can speak with him to ask him where I stand. Please share your thoughts! Thank you.

Received dwi suspension paper but no ticket.
I was on my way to work. The night before I had some drinks. I slept for 6hrs. But when I woke I left for work. About 1/4 mile from i lost control of my vehicle and flipped it. A bystander call the local ambulance and took me to the local hospital for care. I told the hospital staff no blood work. They then told me it was just to check for clots or something. And that a officer can't get my blood work unless I consent. So I went to sleep when I woke. I had an accident report on my bed. A day later I was discharged for alcohol intoxication but still no bac level stated. 2wks later I received a dwi suspension paper in the mail with no bac level stated. Never received ticket. What should I do?

Due to an incident at work, I was given a standard policy screen. I tested + for amphetamine. I take blood pressure meds, metformin, & paxil. Some otc things for allergy & sinuses. NO AMPHETAMINE. I signed the original form to take the test, no other writing on the form. My test was 1st thrown away, then taken out of trash & sent off to a N. Carolina lab, for further testing. I was first suspended that day after strongly denying illegal drug use. The forms were filled out by someone else clearly. The testing co. didn't split the sample, & reported to my employer it was a strong +. I offered to give additional samples & was told I could come back in 6 mos. They reported to the state board, I was addict. I took all evaluations board requested, and ex-empl. gave further reports they 'found' of violations I had supposedly committed during the prior year. My license is up for suspension this Wed. b4 the board. Do I have any recourse. Or can I get anything dropped, b4 this happens & ruins a 33 year career in nursing. Also board has 12 neg. screens from past employers since 1983, they say it doesn't apply to current situation.

In October 2015, I was arrested for DUI, refusal (even though I blew in the machine 3 times), careless driving and driving on a suspended license, even though I had court papers saying my ticket was paid in full the court never released my license. The first two times I went to court, the state asked for a continuance because the arresting officer was not present and the second was because the witness did not show up. I had provided documents that my license was good and that I was not under the influence of alcohol, I was sleep driving due to a medication. The judge accepted the documents I presented and stated that he would render a decision with in a few days and that was in August of 2016. How long do I have before my lawyer can file a motion to dismiss?

Can I plead guilty to do a DUI before the court date?
I was charged with a DUI in Arkansas. Arkansas law states that even as a minor if I blow over a .08, I should be charged with a DWI instead. I'm not sure why I was charged with a DUI, since I blew a .13. Would I be able to plead guilty to the DUI before the court date? A DUI in Arkansas bears a lot less consequences than a DWI.
