I was arrested for DUI, can I get it dismissed?
i was just minding my own business when the cop stopped me...in the report it stated that he saw me driving fast in a parking lot ( i didnt know this was a crime) of a gas station (i was just getting gas), and when i pulled out that I affected the traffic, I blew and came in just over .08... so after researching duis online it says that if the stop is bad then it can get dismissed, so is the stop bad here, and i dont think i was drunk, i would want a trial perhaps, so i know the breath test sometimes are able to be used adn its up and down, so are breath test can be used against me at the trial? what the range of prices for this
You need to take this case more seriously than you apparently are, because I assure you that the cops, the prosecutor...
What is a non-willful situation for probation and what happens in regard to a Orlando, FL DUI? What situation am I looking at?
I am nearing the end of probation for DUI charge in Orlando, FL. From the beginning I told all involved that I no longer have a car and no access to car in order to complete the impoundment condition. I recently provided information that proved I do not have a car and no access to a car. My PO accepted that and said she will take it as a non-willful situation. What all does that mean? I still have an attorney that can represent me but since I no longer live in Florida I now live in OH----just curious what will happen or could.
Each county has different procedures for handling this. The best route is to file a motion with the sentencing judge to...
Can I have the papers served to his DUI attorney since he is representing him on a case, or his parents house?
I am filing a contempt motion against my ex-husband for non payment of child support. He has changed jobs and moved, but I do not know his new address of either his work or residence. I do know he has an attorney for a DUI case. The last residence I know of is his parents house, and that is the one he has listed on our case with the court. Can I have the papers served to his DUI attorney on behalf of him, since he is representing him on a case? If I cannot serve the attorney's office, can I have the papers served at his parents house, where I hope they can sign it, if he is not there but that is the last address I have?
You cannot serve his DUI lawyer. You cannot serve his parents either. You'll need to investigate his current address...

Can my dui arrest (not convicted & pretrial completed) ruin my chances of getting citizenship through naturalization?
I was arrested for a dui on sept 2014. I was not convicted but put on pretrial diversion which I successfully completed. That arrest is the ONLY thing in my record. I'm a permanent resident and I am looking to apply for citizenship very soon. (Permanent resident since 2005)
I am going to change this from a criminal defense to an immigration law questions to get you the most relevant answers...
DUI / Headlight out is not illegal
I was driving home last week from the bar and I got pulled over for having a headlight out which is not ILLEGAL so when he smelled alcohol on my breath I got the sobriety test where I walk and do tests and I failed every one miserably I fell a couple times. My BAC was .34% so not sure if I will get impaired driving for this or not but while I was talking to the officer he said he would suggest i fight the DUI because he shouldnt have pulled me over for the head light out and he said it was out but its not illegal so the sobriety test is inconclusive so i shouldnt get charged with a DUI. do i go to court anyway or should i just skip it all together since it'll be thrown out anyway??
I have never heard of a police officer telling someone they stopped them illegally. I would image in the police report...
So how is it that Florida can pull my licence for crimes committed in another state, when they are taken care of in that state?
I was convicted for 4 drunk drivings in a 5 year period in the state of Wisconsin. I had become a habitual traffic offender. On August 21, 2015 I had been deemed eligible by the state of WI to drive again, I then paid all the fees to get my licence in WI and transferred it to Florida. A month later the Bureau of Administrative Reviews made the decision to pull my licence because the convictions were so close together. my convictions were 12-15-2005 2nd 05-01-20073rd 06-15-2007 4th and 06-07-2010 5th. So how is it that Florida can pull my licence for crimes committed in another state, when they are taken care of in that state?
Florida statutes provide for the permanent suspension of the drivers license of anyone convicted of four DUI's no...
