If marijuana is legal in my state, is the smell probable cause?
A police officer spoke to a group of people I was in and told a story of how he pulled over a woman who was all over the road, and when he approached her she reeked of marijuana. He said that she most definitely had to have smoked prior to getting in the vehicle, but since she didn't match the textbook definition of "impaired" based on his field sobriety test, he let her go because marijuana is legal. Not all cops are the same as this one, so arguably, if you are in a vehicle (operating or passenger) and you are pulled over, does the smell of marijuana coming from the car warrant a search even if it is legal? Specifically when the driver/passengers do not exhibit signs of intoxication?

Bloodshot eyes grounds for arrest?
I was arrested last night after a cop approached the parked (idling) car I was sitting in and began questioning me on my activities that evening. I am an adult under the legal drinking age and admitting to consuming one beer a few hours ago. The cop used the grounds that my eyes were bloodshot to administer a field sobriety test, which I passed. I was then placed under arrest for "Operating without a license" and taken to the country jail. I was fully cooperative with the officer. I ended up blowing a .04 on the breathalyzer test administered at the jail. I posted bail and left. Are the grounds on which the officer arrested me legitimate, and as this is my first offense is there any chance of the charges being dropped?
