Is it possible in Washington State for a court to waive the requirement of an ignition interlock in a deferred prosecution?
I did not have a license at the time of the arrest. I have financing to purchase a new vehicle from a dealer. I do not have a license in WA State, I cannot get a license without an ignition interlock device installed. I cannot purchase a vehicle without a valid WA license. I've been in my deferred for 15 months no violations.
You're in a sticky situation and generally speaking there isn't a waiver for something like this. Can you put an IID...
Has my husband been arraigned?
My husband was pulled over and arrested for driving while license suspended in the 3rd and no ignition interlock. I posted the $1500 bail the same day and brought him home. A few days later he went to court. His name was called and he went before the judge. She would not allow him to speak with the public defender that was representing everyone nor was he given a chance to plead guilty or not guilty. The judge exonerated his bail and then promptly raised it to $2500 cash or $25000 bond. He was immediately placed in cuffs and taken to the county jail where he will continue to sit until his next court date, 45 days from the initial court date. My question is, has he even been arraigned as he was unable to enter a plea?
Hard to say without seeing the court docket reflecting what actually happened that day. The judge may have revoked...

I was charged with a dui when I wasn't in the car, just standing near it by home. Can they charge me?
I was not "operating" the vehicle, waiting for a friend to pick up the car that was down the street from home. I was standing by it. Cop says there are witnesses saying they saw me behind the wheel. Not true, there aren't any and cop doesn't have any names, etc., because I was not behind the wheel and there are no names on police report. I was drinking, but at home, not arguing that before I walked down to the car. Cop also stated that my friend who showed up later said I was driving and put that on police report, also not true. Friend showed up after cop, so how's that possible that he saw me? Lawyer says they are charging me based on witness accounts, but they can't provide those witness's and friend says he will testify in court that he never said such about me driving to the cop.
The police and prosecution can charge you with anything they want. If there are any facts in dispute and those facts,...
I am being charged with a DUI based on Police Report with false statements. Can I sue the cop in civil court for false report?
The city is charging me with a DUI and the lawyer says it's based primarily on the police report filed. Within the report the officer states that witness "A" said I was driving. Witness "A" did not say that to the officer and will testify in court to such should we go there. Witness "A" wasn't even there till after the cop arrived. Also the officer stated that there were other witness's to say I was driving, but can't produce any names, etc. I absolutely was not behind the wheel, so there can't be any witness's to such. I shouldn't have to pay for a crime based on false statements by this officer and want to know if I can sue him in civil court for all the monetary loss, etc. this has caused me.
Yes you can. However, in general police officers are immune from being sued for actions on the job. You would have to...
