With a second DUI arrest, what are the chances of having the charged lessened to a reckless ?
I was arrested in 2011 at the age of 19 for a DUI. My charge was lessened to a neg 1 and I have had zero police interactions until two days ago. I was pulled over and arrested for a DUI , 6 years later. I blew .121 . I am a full time college student with a 3.9 GPA. Also a single mother who only works one day a week. I am wondering with the new laws for DUI in Washington state the probability of being able to plea to a reckless and not have to face more jail time and other mandatory requests. I have already put in an ignition interlock in my car as required upon my release from jail.

I got a dui almost a year ago in Oregon. I was not aware of it right away that Washington decided to extend my deferred prosecution until they sent me some mail saying I was in violation. I served my time in Oregon then went to Washington and served my time there as well. I had already done the victims panel and gave a copy to probation in Washington just before checking myself into jail. All seems like it was going well until I get another letter for a show cause in Washington for not doing the victims panel and not being in treatment. So through a worthless public defender I resent my victims panel card and all the other things. I assumed I'd get to court and they'd tell me sorry for wasting your time. Instead I get to court and my public defender didn't even show and the prosecutor claims they had no knowledge of my dui in Oregon and that I was trying to hide it. The whole reason I got in trouble in Washington was because of Oregon. They are either lying or they are really that disorganized. Whichever it is they are definitely overzealous because now they say I need to do a year in jail. The date has been pushed back. My lawyer sucks at communication. What's realistic?

Dismissed Dui, will they refile?
I was arrested for refusing a field sobriety test on a probable cause dui. I submitted to the station breathalyzer and blew a 0.03, however was imprisoned for the night and went before a judge. The state prosecutor laughed and said "your honor we are dismissing this case, I haven't had time to file it". The judge released me and I paid no penalties. The paperwork says all future court dates and issues are removed, but to be aware the prosecutor may be able to refile. So what can I expect now, being that my BAC was .03 and it was dismissed, I do have a prior dui reduced to negligent 1.
The judge stated that the State can refile. You need to keep an eye on this to see if they refile.

Are field sobriety tests normally not administered when you're accused of resisting arrest?
When I was stopped by state patrol they said I was resisting arrest, I don't believe I was, the whole arrest is questionable right now from p.c. to the breath test and no video, but I was told Thats not a big deal, I sure think it is! My public defender is looking into it. Anyway, since they used force on me to get me out of the car, so due to that, they did not administer field sobriety tests. Im just curious if this happens much, and what lets them make that decision. It seems like evidence that they would want to build p.c. It says in the dui report that is why they weren't administered. My public defender isn't much help. I have trial on the 22 and I've had one meeting with attorney. I do not feel prepared. Hoping maybe to get it lowered to a reckless driving or negligent driving if we fight do out the arrest was good. But my BAC was high, but impossible for it to have been that level at the time of driving.
