How do you defend yourself against a DWI when you were not in the car, and there were no keys in the ignition.
I was out, had a designated driver but because I was by the trunk of the car getting something out they did the breathalizer and gave me tickets for DWI.
One element of a DWI charge is operation of a motor vehicle. The prosecutor must prove this beyond a reasonable doubt....
My 21 year old son left a friend's house drunk. In New York State does the host have any responsibility to stop him?
He was hanging out at his friends house they were drinking and they allowed him to drive home. Thankfully he didnt get hurt just arrested. I want to know if I can hold the parents responsible so that I can get help with the fines.
Potentially. You should contact a civil litigation attorney and/or repost this in litigation or lawsuits and disputes...
My attorney betrayed me and tried to neglect my criminal case, a misdemeanor DWI, with DMV refusal hearing. What do I do?
My attorney advised me to plead guilty to a lesser charge out of retaliation for a perceived slight and a sense of arrogance and entitlement. This was grossly inappropriate legal advice as he did this without first arranging to get from me and examine exculpatory facts and evidence I repeatedly told him and his staff I had. I sensed what he was doing and I did not follow his malicious advice and have not plead guilty. There were other clear points as well on which he failed to prepare for proceedings or safeguard evidence that might be destroyed. He will covertly neglect and sabotage my interests (he has already tried). I would like to know 1) how to properly terminate the attorney-client relationship 2) any recourse to recover my fees 3) any recourse to pursue a legal malpractice case
You terminate the relationship by hiring a new lawyer. You can not sue for legal malpractice unless you can vacate the...
According to documentation my license was to be revoked for 1 year. I recently (this morning) was told that I can apply to the Driver Improvement Bureau all I want, but they will NEVER allow for me to become licensed again. Leandra's Law was signed in Nov. 2009, and went into affect Aug. 2010, Why, if in fact was I charged under the Leandra's Law if I was arrested prior to?
Actually, it's not Leandra's Law which is keeping you from getting your license back, but it's more recent...
I lost my license in PA for DUI's. While it was suspended, I moved to NY. I have completed all the requirements and have received a letter from Penndot stating that my driving privileges have been fully restored. Can I take that letter and a proof of address now to NYS DMV and get a NYS license?
Go to DMV and find out. The worst they can say is NO but I think you can get a license if your privileges in PA have...
If you have 2 prior convictions of a dwai and a dwi and get convicted of a 3rd dwi with a accident what will happen?
2 prior convictions of a dwai and a dwi and get convicted of a 3rd dwi (BAC- .12)

I suggest that you consult with a Traffic Court lawyer. There are some good ones on Avvo. Try the Find A Lawyer tab.
