I was not driving. I was waiting for a cab and fell asleep. Never drove. It was snowing and cold out and I had to warm up. I havent lost my liscense yet, still on my 30 days suspension. I know someone who has a friend that got arrested for sleeping but it was not a dui, it was something to do with not having control to drive because he was sleeping.
Some state laws may still charge for a DUI even if you're not physically "driving" a vehicle. Instead your specific...
I was convicted of a DUI Perse in 2010. I just graduated college and got an amazing engineering job offer, but the company is very strict on background checks. I was wondering if there is any way possible to seal, expunge, or block my DUI from being seen by the company when they do my background check.
I recommend that you contact an attorney in Montana. In Florida, a DUI sentence requires a conviction, and a criminal...
Husband went to bar a little after 9 : 00pm , had a couple beers and left at 11 : 15pm . Police stopped him in bar driveway . Submitted to all tests , was taken to station and charged . After being charged he was taken back to his pickup and he drove himself home just like was doing when they stopped him . They could have called me to come over , it is only a few blocks away . Pulled over for speeding, 42 in a 30 mph zone. Officer smelled alcohol coming from my car.
PBT was 0.14. He then conducted the HGN, Walk and Turn, One Legged Stand.
Said I failed the HGN and Walk and Turn (failed the Turn part, not Walk). Passed One Legged stand. I was arrested.
There was absolutely no slurred speech, stumbling when I was walking, I was driving perfectly when pulled over, no lane changing, swerving. I was just speeding.
I refused blood test. At the DMV hearing, my attorney proved the officer conducted the HGN incorrectly. The DMV hearing officer threw out the HGN. License still suspended for refusing blood test.
City Attorney offered plea bargain of Reckless Driving, no jail time, 1 year unsupervised probation.

I have lost 3 job opportunities because the "Failed breathalyzer" is on my record. My lawyer says it is best to let it play out, but I don't know how much longer I can wait with the job I have now. I am stuck here because of the record. I call my lawyer every week, what else can I do without making waves?
If the failed breathalyzer is on your record as a result of an implied consent violation it will remain on your record...
