Can a person lose their dr lic. for refusing blood test for 12 months from the DMV, then have the court add dui charge also?
i was walking with keys in hand oct 2012, 3 cops approached, refusal of chemical test cost an suspension of lic. for 12 mos, due to be reinstated march 2014, however after going over restoration letter from DMV i saw that the day i am to get it back it is going to be suspended for an addtional 12 mos as the court charged me with section 3807. this is my first dui, how can i be penalized twice? on my sentencing and order of june 7th it said Dui and resisting arrest so I assumed it was talking about the refusal of the blood test. the court charge is from the same incident. because i did not meet the 18 mos susp, intially i was unable to apply for occupational license for my medical appts, I am disabled..is there any way at this point i can have my lawyer appeal this? advice please thank

Last night I was arrested for a DUI charge. However, there are many circumstances that do not make sense and I am unsure of whether or not it can be upheld in court. I was in a local store for almost an hour before the cops showed up for a verbal altercation that occurred in the store with a bunch of people. I did have some to drink, but not a lot. I snapped. I couldnt believe the things I was hearing. About an hour after police reports and what not, they made me submit a test to see if I was capable of driving home. I failed the test. Two hours after the fact that I 'drove my car' I was also in the store drinking while waiting on food. I even called for a ride in the store from my cell phone. They took me to the hospital threatened me with jail time if I refused the blood test.

They offer an asp program where i am doing as they ask but as of now i only have a trial date and heard i should have another date before that, and also i am not sure what to expect. I have read 90 days mandatory but was wondering if that means 90 days in county prison or other alternatives?
