I was pulled over for suspicion of OVI. When asked to blow I refused. What are the chances of a reduction in charges from an OVI
I have no prior criminal record and no prior traffic violations. I was told by an officer in the same county that I should be able to get it down to a reckless op or physical control. What is the difference between the two?
This really depends on how you want to handle this matter. You can go to trial, and hope to beat the charge all...
Is it legal for someone to get info from the court concerning if a certain person is at a 72 hour driving intervention program?
I was not charged with an OVI; however, I did have to take the classes in the DIP program. The superintendent of the school where I work called the Municipal Court and got information that I had to go to the DIP classes and also told him the specific dates I was there. He's actually claiming they called him. He handed me papers this past week, and said he was putting me on immediate leave, and requesting to the board of education that I be terminated the 27th of this month, which is their next meeting. Do I have a case against him?
One of the best parts of our legal system is that it is public. Except for very few proceedings (such as child...
In OHIO when is a person considered under "arrest"?
I was pulled over for OVI and the officer made me do field sobriety tests, then put me in cuffs, took me back to the police station. He read the BMV 2255 form that stated I was under arrest, and made me submit to a breathalyzer. He released me to my family shortly after. Was I under arrest under Ohio law?
Whether you are under arrest depends on the circumstances. The actual question you should ask is "were you in custody?"...
Is it possible to file with the court to get my license back before the suspension is up? How do I start the process?
In 2012 I plead guilty to my 3rd DUI. Had a public defender at the time with no DUI experience. Although I was less then a mile from home, did not wreck, cause any harm to others and fully cooperated with the officers (same for the other cases). The judge gave a a 10 year suspension and I am not allowed to have a car titled in my name either. I went through all of the rehabilitation, completed probation without an incident and have continued to stay on the right path since. However, my job is starting to require mandatory overtime and it is causing an issue for me since the bus I ride doesn't allow a change in my hours.
The best move would be to hire an attorney to file a motion for occupational driving privileges. If granted, the judge...
Will they just see that my levels are decreasing from Test 1 to Test 2 or will a failure on the second test hurt my case?
I was arrested for DUI and ordered to take 2 pre trial drug tests. I know I will fail the first and possibly the second. The time in between the tests is 10 days and I fear my system will still not be cleared. This was not a drug related arrest.
If your levels decrease, you'll be fine. If they increase or stay the same, you'll have a problem. I hope you have an...
Getting a license in ohio after a dui in california.
I got a dui in california last october, i after that had my license reinstated after signing up for alcohol classes and getting the idd put in my car, last month i decided to move to ohio and i was informed i could get a license here after waiving my rights to have a license in california for 3 years. After i moved to ohio i called the dmv mandatory actions unit and asked them to send me that waiver packet and they said i can only get it after my suspension period is over. So my question is , is there no way to get a license in the state of ohio until my suspension peroid in california is over?
The DMV controls the terms for obtaining an Ohio license. If they tell you that you have to wait until the CA...
What should I do? What could it be?
Over two years ago I got my second OVI while still finishing up probation for my first 6 months earlier. I screwed myself. I did the car breathalyzer, the anklet, the house arrest, the community service, the random drug tests, the year of probation, the 10 days in jail. All that's left is renewing my license after the two year suspension. I went down to pay my fines. Warrant block from a failure to appear 2 years ago. No bond. I'm freaking out. When I got these charges I was living in my mom's basement, with no job, and a bum. Now I'm living on my own, had a job for a year, have bills and an actual life. I called my attorney and he said I need to go to AA and get signatures to prove I haven't been drinking and then call him to handle it. Doesn't my life itself show that I'm doing better?
Unfortunately the judge is going to want more proof than just your word. It sounds like you have made some important...
