Can I sue drug testing labs for a false positive drug tests?
I was on probation for a year for a dui , I passed all random once a month for a whole year and on my last day of probation I was told I had cocaine in my test that was taken a month ago. I have never used cocaine in my life. So I took a forensic hair follicle test to prove I am clean for all testing. I hired an attorney to present this to the head of the probation department and they cleared my case and now I was cleared and my probation. This is a testing lab that has been on the news several times for tampering urine tests causing false positives on about 300 people. There are facebook pages on jams of many complaints against the company. also there are blogs on people also writing on their false positives. I am truly tramatized by the injustice I was forced to go through, it was a severe injustice to me. I really want to be the one to show to the public that they can't get away with this. Since I was told by my probation officer at the end of my probation, he said I could have jams send the test to another more lab in California for more testing. A full month went by , and told this a little to late. I should have been told this when they received the dirty results.
From a lawyers perspective, you got justice and the system worked. What failed you was the testing. That said, you may...
I forgot to call the ua hotline on time on Thanksgiving and was wondering if that would violate my probation?
I got caught up in making Thanksgiving dinner and it totally slipped my mind to call but I did call the drug testing center that I have to report to when I'm required to test and they told me they were closed that day and I wouldn't have been required to test.
Since you would not have been able to test, it is unlikely you will be violated. However, if you do get a violation,...
