How do you use your "Right to Travel" to beat a "driving on a suspended" case?
My husband got arrested for driving on a suspended(dui). However, the constitution states that drivers licenses are only required for drivers who drive for a living/compensation and that every American has the right to travel freely on public roads, by automobile and no license is required. It also says that no state laws shall over rule or take this right because that would interfere with a persons right to life , liberty and the pursuit of happiness, which means that every American has the right to drive without a license as long as they are not getting paid?Am I wrong?
I am sorry ma'am, but yes you are wrong and your legal analysis is wholly inaccurate. A lawful driver's license is...
My friend was on house arrest for a 3rd offense DUI, he's back in jail because of a "Pretrial Misdemeanor" What does that mean?
A friend of mine was placed on house arrest after receiving his 3rd offense DUI. I believe he got sentenced to 2 or 2 1/2 years. However, I haven't been able to get ahold of him for a while now, so I ended up checking the current inmates for our state (West Virginia) online and go figure, there he was! It says he was booked on 3/2/16, so he's been in there over a month, his bail is set at $1,000, and above his name it says PTM - Pretrial Misdemeanor. What does that mean? Did he violate his house arrest or is this a whole new charge?
Those codes on the jail website are usually incorrect, but not always. If your friend is in jail, it is most likely...
Can someone please help me get my license and all my money back from these bogus charges
This still contains to the first situation about the DUI case I got screwed over on. If someone would please contact me or give me a contact number I can give a better statement of my situation. I appealed DMV case, went to court at DMV, officer shows up at hearing lying and when I called him on it he jumped up out of his chair and said, im done here. Through his folder on the table and walked out of the court room and left in his patrol car. We was only about 10-15 minutes into the hearing when he went storming out threatening me at the same time and they didnt even throw it out over his actions they found me guilty 3 months later and took my license. Now after going through everything they ask me to do I violated their program because I drove a frinds car 1/2 a mile into town to help out another friend and got pulled over and arrested for not having the interlock device in that vehichle. If judge Jenkins from the Preston County WV court house is correct I shouldnt have been put on yhe program to begain with because the DMV illegally revoked my license in the first place because I represented myself in their court room instead of hiring a lawyer. Please help me and be rewarded
No one will contact you from this site unless you first contact them. You can use the find a lawyer tab to locate...
Can I fight a DUI Suspension that was not turned in as a DUI. The charge was Driving on a suspended 1st offense.
I was stopped and charged with Driving on a Suspended 2nd offences in April of 2015. In August I had a hearing and the charges were dropped to Driving on a Suspended 1st offense. Now three months later, I get a notice from the West Virginia DMV stating that my license will be suspended for 1 year for DUI. While my BAC was .05 which is under the legal BAC of .08 in West Virginia there was not charge for DUI even discussed. I have talked with the arresting officer who also agreed that there was no DUI charge and that it was only driving on a suspended 1st offense that was turned in to the DMV. I attempted to explain to her that the charge was not DUI but she would not listen. I moved to Orlando Florida just after the hearing. I am just at a loss as to what I can do.
Generally speaking, DMV and court aren't the same, that's why you can be charged in one and not the other, for most...
Possibility of underage consumption charge being dropped.
Over the weekend I was stopped by an officer and given an underage consumption ticket with a court date on March 17th. The officer said to me personally "If you just show up to the court date the charge will be dropped". There was a friend with me when he said this. I am turning 21 on March 1st and he said it will be an early birthday present. Do you think he was saying that just to get me to show up to court or is there an actual possibility that the charge can be dropped.
You should hire an attorney to represent you on this charge
DUI first timer program/out of state
A received a DUI a few months back in Morgantown WV, and was placed in the first timers program, which requires me to get an interlock placed in my car and take AA classes. I am currently living in NJ. How do I got about finding the classes in my state? What are the requirements, and can the classes be taken online? Thank you in advanced!
You can find local AA classes online by AA.org. My understanding of AA is that it is more of a meeting, and not really...
