How do drug screenings work for dui classes?
I got a first offense dui in Fayette county, wv. Of course I'm required to go through the DUI classes. I am afraid I may test positive for THC should they screen me the first time. Is the first screen a "gimme" and then I must pass the rest? Are the tests at FMRS supervised? What if I have a prescription for medical?

They pulled me over cause he said the truck didnt look legal.I pulled over he came to the window an asked for li ins an everything i said i dont have any.He told me to get out the truck an i did i was very respectable .He put me in cuffs never read me my rights and put me in the cop car.Now this happened dec.1 2016 i have court feb.6 2017.My dui was back in 2005 because i didnt take the breath alizer .Now that being 11 years ago what will they do i talked to a lawyer an he said just have to see what happens when we get there.This happened in fayette county wv.What do you all think will be the out come? Arrested for DUI and speeding
Hi my bother-in-law who's from Mexico City and was staying here for a couple weeks work related , got arrested over the weekend in Fayette County, WV for a DUI and speeding at 100mph , he was suppose to flight back to Mexico on Thursday. He has a Mexico drivers license and has never lived here before therefor he is not familiar with the driving laws.. He was bail out by his boss and was told can't leave the county until his court date, but his court might take up to a month. Can he ask for some type of permission and come back for his court date? what are the chances that he might get his case dismiss or clear since he is not from here or lives here's at all. Should he get a lawyer? What are his best options ?He's being charge with a felony and a misdemeanor . He's staying at hotel !

What does it mean to be summoned to court for the status of DUI deferral program?
I was convicted of my first DUI two years ago in which I blew the minimum limit .097. I attended the 6 week drug and alcohol class a year ago. I did not have the interlock system installed in my car. Is this the reason for which I am being summoned? Because I was under the impression that I did not have to have the interlock given the circumstances of the situation.

Arrested for dwi in NC, but a resident of WV?
I was arrested for DWI in NC while on vacation. My driving privileges in NC are revoked for 30 days. If convicted, driving privledges will be suspended for 1 year from conviction date. I have hired an attorney in NC to fight my case, but if convicted my understanding is I'll be treated as if the DWI occurred in WV. If this happens, will I be eligible for interlock after 15 days as in WV, or will this be denied to me because my suspension is for 1 year in NC? This is first offense, Breath test of 0.13, no agrivating factors, and no property damage.
You will probably want to consult an attorney in WV as well, and don't wait until the NC case is done and over with....
If you enter and pass a pretrial diversion program for a DUI do you then have to admit to it later?
I was in WV and got my first offense for a DUI. I entered a pretrial DUI diversion program and I passed the program completely. Do I have to admit to future employers about the DUI? Or since I passed the diversion program is it not something I have to admit?

Will DUI Conviction appear on Driving Record if successfully complete deferral option for first time DUI offenders in WV.
First time DUI offender with BAC <.15; offense occurred in West Virginia, Driver is licensed and lives in Florida. I plan on pursuing the deferral route so that the criminal offense may be expunged in time. My question is, what is recorded on the driving record when going the deferral route? My insurance policy states points will be assigned for DUI "Convictions." My understanding is criminally under deferral a conditional guilty plea is entered, and no conviction is ever applied if you complete the deferral successfully. What about the DMV side of things? Thank you.
Provided that a conviction isn't transmitted to DMV in WV, or to Tallahassee, there should be no record of a conviction...
