Should I hire an attorney to fight an OVI charge with a breath test of .079 & no previous offenses?
I was pulled over for no license plate light. I was given the field sobriety tests and breath test. I was handcuffed & taken to the station. I was given another breath test that registered .079. I have never even had a ticket before. I have no credit card to pay an attorney. I was unemployed for over a month and just started new job so have no savings. I received a plea offer from the prosecuter. I have an appointment next week with my lawyer. Is it common practice to go back and ask for something else or is it one and done?? I don't really like the offer.. 6 days in Jail, $1000 fine and 6 month suspension and yellow plates. I have a 7 year old prior and a 22 year old prior. I was pulled over for having a loud muffler and was arrested for an OMVI. I was assigned a public defender. The public defender told me not to appear in court on the first two dates that I was given and that I should contact him after I recieved the discovery packet. Upon me contacting him he told me to take the prosecutors recommendation and told me a date to appear in court. We never discussed my options nor my concerns for the validity of the initial traffic stop. So I contacted another lawyer who attempted to take over my case but the judge overruled all of his motions including one to supress stating that the time to submit those things had passed and that we were going to trial.
