I will be pleading to a DWAI in NY. If granted a conditional license in NY, can I still drive in NY with a NJ suspended license?
I was arrested for a DUI but was able to plea down to DWAI in NY. I have a NJ Driver's license. I know NJ will administratively suspend my license but NY will hopefully grant me a conditional license. Can I still drive in NY?
If you take the DDP in NY there is a chance that NJ may not get notice of it. I've seen it happen for a number of my...
I was arrested in June 2010, and convicted December 2010 of a 'felony' DWI.
According to documentation my license was to be revoked for 1 year. I recently (this morning) was told that I can apply to the Driver Improvement Bureau all I want, but they will NEVER allow for me to become licensed again. Leandra's Law was signed in Nov. 2009, and went into affect Aug. 2010, Why, if in fact was I charged under the Leandra's Law if I was arrested prior to?
Actually, it's not Leandra's Law which is keeping you from getting your license back, but it's more recent...
Is it possible to remove suspensions or revocations from a New York Driving Record Abstract?
My husband was originally arrested for numerous charges, including DWI. He was not convicted of DWI, and this charge has been sealed from his criminal record. However, I realize that the DMV is a separate entity to deal with. His license was suspended immediately due to a chemical test refusal. It was then revoked after a DMV hearing. Is it possible to remove this from the driving abstract? Will it ever go away after a certain time period, or will it be on the record permanently? What about if we move to another state? Thank you.
This chemical test refusal and revocation are part of his permanent DMV record in New York State. There is no way to...
Interlock Lockout, what's the violation?
I was getting ready for work one morning a little earlier than usual and when I gave my breath sample to the interlock it failed. After a few minutes of panic later and I ate some bread and rinsed my mouth out with water. I gave another sample and it failed. I got a lockout. I didn't drink before work or the night before. I assume the mouthwash set it off? I checked and it's about 13% alcohol. What could the judge do?
It is always best to consult your local attorney in your area.

Is it unusual to be offered conditional discharge for 2nd felony dwi in less than 5 yrs?
First Dwi was felony dropped to misdemeanor. Second is felony since caught in less than 5 yrs. Why would a court offer this for a felony.Does it mean there's something unusual, hard to prove,or weak case or something?
It is unusual unless there is a low reading which may make it reasonable. Joseph A. Lo Piccolo, Esq. Immediate...
