What can I do about a noisy drunk neighbor?
I have a very loud across the street neighbor, he is in his mid eighties, he is so loud I can hear him hollering across the street with the windows closed. Lately he has been getting drunk and stumbling in the street, and recently invited a young seedy couple to move in with him. Well tonight (about 10:45 pm) he was drunk and tried to punch the man, and was yelling at them while they tried to escape in their noisy beater of an SUV, in an attempt to get away they tried to drive off while my neighbor hung on. Luckily he was dragged about 10 ft. and let go, only to fall into our ditch headfirst, then he got up and stumbled back into his house. I am ready to scream at him, but that wouldn't get me anywhere. We've had to call him in due to prior noise disturbances and elder abuse towards his elderly neighbor. My question is what can I do?
Call the police when things like this happen, if only for a welfare check. Drunk in public, noise nuisance, assault are...
Citizenship and DUI / DWI
I had a DWI in 2006 which resulted in PBJ and another DWI in 2007 (after first probation had ended). The second DWI got me 3 years probation but no jail time. I completed all requirements and the probation ended in December 2011. I had no infractions since, except for two minor traffic tickets. My Green Card expires in September, 5.5 years after the end of the last probation. What would be a prudent course of action? Apply for Citizenship? Apply for a renewal of Green Card? Do nothing? I have a disabled 16 y.o. child, an American citizen. I'm divorced from his father and am the sole caregiver. It has precluded me from having a regular job. I own a small business, but it's only intermittently active. I haven't traveled out of the country for 17 years. My FBI record, strangely, doesn't show my two DWIs, but I know I can't lie on the application. I'm afraid the discrepancy in records may complicate things. I'm afraid to put myself on the radar. Also, I have a significant one, who is an American, but we are not officially married. Would marriage give more weight to the application? What else can I do to increase my chances? Thank you in advance!
I would apply for both at the same time and make sure to work with an experienced immigration lawyer and have him/her...
Motion to modify DUI conviction after 90 days?
My attorney dropped the ball and it's now about 120 days past conviction. Is there a way I can still request a motion to modify my conviction to a PBJ(It's been more than 10 years since prior)?
A motion to modify must be filed within 90 days or it cannot be modified to a PBJ.
Will I be charged with dui if I was drunk and had an accident, but wasn't breathalyzed ?
I was driving home drunk, not sure what happened maybe I passed out behind the wheel. I wake up to see I had crashed. Ambulance came and got me but I wasn't tested for alcohol by police whatsoever
Yes you can and expect to be charged. Your blood taken at the hospital can be used as evidence. The presence of alcohol...
How do I answer a question on a job application about a PBJ from a DUI?
I am applying for a job, the question asks " Have you ever been convicted of or plead guilty/no contest to a criminal offense?". I received a PBJ in 2010 for DUI, there are 2 different case numbers for the same incident/charge. The 1st says...plea: other, disposition: nolle prosequi, the 2nd says...plea: guilty, disposition: PBJ. How should I answer this question & why do I have 2 different case numbers with different results. Please advise.
Your situation is why I always arrange for my clients to plead not guilty, but agree to proceed on a statement of facts....
What is the BAC level to be charged with DWI in Maryland?
My understanding of the law is that If a driver’s BAC is 0.05 or less, then the presumption is that the driver is neither under the influence of alcohol nor impaired by alcohol. On occasion I stop at the bar after work and have 2 beers over a hour and a half period. The Bac charts say at my gender height and weight I would at approx. .035 to .04 My question is can I charged with DWI at this level? I imagine this would be a very weak case. In your experiences have you had clients charged in this BAC range?
The DWI limit is between .07 and .079% is enough for DWI and .08% for DUI. In MD, they may also try to make an...
When I'm falsely cited for a crime I didn't commit because of an identification issue, what are my options?
A friend of mine was in possession of my drivers license when he was drunk and cited for failure to ibey a police officer. The officer charged me with the offense because he found my license and assumed it belonged to my friend. I recently received a letter in the mail explaining that I was charged.
You will need to go to court. The statement of charges will have a description of the individual which will not match...
