Since it is over 30 days, what are the chances of having this case dismissed. Does this have to be done in front of a judge in court? Is just the breathilzer test admissible; it was just over the .08 limit.

I have not been convicted or sentenced for charges (DUI 3 rd) and I was released the next morning,how will this affect pending sentencing at my plea/sentencing hearing in June and I believe my release was a clerical error,but I was allowed to leave so I did. Can they come re-arrest me if the release was a clerical error and error is later discovered and do I have to sit in jail until my court date in June and how will the $8000.00 signature bond be handled? Can I request a separate hearing to deal with bond violation sooner than June date and would bond be offered again?
If the DA failed to arraign you within a timely manner, most DA will later arraign you at another date.
I got a 3rd offense OWI. I "failed" the sobriety test, but I don't feel I did that poorly overall. Also I don't feel my driving was impaired. My BAC was .07. I was pulled over for not having lights on, I turned them on before I was pulled over. Is there a chance I can get the charge reduced to something lesser? I am trying to avoid a 3rd OWI in Wisconsin. Is it something that is only reduced at pre-trial or what?

I had a WI license. I received supervision for DUI in Illinois (meaning my insurance company cannot see it). However, WI just suspended me for this Illinois DUI (since they don't have supervision). Question is....even though IL won't report the supervision....it is possible my insurance company will still find out from Wisconsin?
Illinois reports DUI supervision to the licensing state. That's why WI suspended you.
I was convicted 3 years ago for my 3rd dui. I plea bargained for 2 years probation and 30 months of iid along with 3000 dollar fine. I did the first 2 years of probation with no violations only I wasn't able to pay anything on my fine as i was unemployed and pounding the pavement for a job. I am currently employed and been paying 200 a month to my PO on my fine and currently bought a car with the SR-22 insurance. Is it possible to get the 30 months reduced to lower time frame or is that the mandatory length for said offence. My bac. was .24
As part of your sentence, the IID order length can't be shortened unless there are grounds to modify the sentence....
If a person gets a drunk driving and has their assessment but does not complete the requirements for the drivers safety plan, can they get a drivers license ever again? Is there any other options a person can take like petition the court for some other sort of punishment or amendment. Its been 2 years since the drunk driving conviction.
The person will need to complete the requirements before becoming eligible to reinstate. They do not time out.
