I was convicted of 1st offense DUI. DMV sent me a notice to get an Ignition Interlock Device (IID) for my vehicle for 6 months but I sold my car last year when I received the DUI and have been riding a motorcycle. DMV doesn't offer an IID for motorcycle so I'm forced to get an IID Exemption. DMV says it takes 4-6 weeks to get a decision on the IID Exemption but it has been 10 weeks. Is there any other legal solution since the DMV does not offer IID for motorcycles but it is a requirement?
Unfortunately there is not. At this point there is no IID for a motorcycle and I highly doubt there will be one in the...
My two knuckle-head friends were shooting at each other with pellet guns while drunk. One of them shot the other in the chest.
The bullet went through her body and the doctors are not sure whether she will survive or not. Keep in mind that it was a complete accident and the other girl, I think, will most likely survive. The other one got arrested and was released on bail and was charged with aggravated assault with a deadly weapon. Is it possible to point out to the DA that they were drunk and not in the usual state of mind during the incident? Can the charges be lowered in this unfortunate case in any way? What are some possible outcomes? It was an accident, the other person will not press charges and she was under the influence of alcohol. (I'm hoping that the whole alcohol thing could help her out although it probably is my wishful thinking).
Individuals do not make a decision whether to "press charges" or not. The District Attorney reviews police reports to...
A cop arrested me for me refusing to show him my ID at a bar. Will I win in court?
You have not set forth enough facts. This is posted under DUI. Were you charged with DUI? Disorderly conduct? Public...
I just got arrested on 10/12/13 for DUI this is my second offense. The first one was eight years ago.
There was a object on the freeway that broke the tire and then hit the metal curb guard (it was the connection of the 710 and 405) no collision with other car. I couldn't find my cellphone to get help and after waiting for a while and no one showed up to help I decided to walk. I was then picked up by CHP on the 405 freeway about 1.5 to 2 miles from the car. Accident happened about 2:00 am picked up by CHP close to 3:45 am. Booking time 4:39 am in Long Beach City Jail. What are my options? Thanks for advise!
Depending on your BAC certain issues could potentially be disputed. Based on the facts and timing of your case your...
when your turn yourself in, i know you have to stay in jail before you go to the judge. when you go before the judge do you get jail time added for your original case for the dui. lets say the judge gives me 180 days in jail. and for the failure to appear how much jail time can be added for the FTA? what is the usual FTA sentence that a judge can give you?
You don't ever have to go to jail, possibly. If you get your warrant recalled and quashed, you may not have to do jail...
Hi guys, I received my first DUI in San Diego. I have my arraignment in one month. Will not be able to afford a lawyer. Go to school in Los Angeles. Intent to plead guilty (or no contest if available), but would like to request dui classes/probation/ etc. to be served in LA. Should I write a letter to the San Diego court explaining this prior to arraignment. Ready to accept full responsibility as soon as possible to start getting back on the right track, but need to know best possible way to approach this. Should I attempt to get a public defender in San Diego? Any advice helps...
Speak to the public defender and if you qualify then use them. Don't do this on your own because the judge must...
I refused to take a breathalyzer & blood test. How can a lawyer help my DUI case? Can I get it reduced from a misdemeanor?
The CHP officer that pulled me over told me that i got pulled over for switching lanes without signaling and for almost cutting off a car. He told me that I smelled like alcohol and asked me to take breathalyzer test and or blood test, but I refused to take any of them. I was taken to jail and released after about 14 hours. I'm currently in school to become a special ed teacher. A misdemeanor would completely throw me off track for a few years. Is there any possibility of getting the case dismissed or dropped to an infraction? I'm not sure what to do. Any advice would be great, please help me. Thank you
There are a lot of factors that go into getting a case dismissed or reduced. You also have to worry about the DMV...
