Will I have to have my ignition interlock for both DUI consecutively?
I had a dui in 2011 and my drivers license was revoked for 3 years. I received another dui in 2015 and still had not installed an ignition lock in my car. Now will I have to have it installed for the first and the second.
Yes, 2 different charges means consecutive interlock periods.
Would this fall under double jeopardy law?
I was arrested on suspicion of dui and a traffic violation. I had gone to the holding for a few hours then they finally drew blood from me. I got my court date upon my departure . I had went to my court date on 10/12/2016, the officer failed to turn in her citation and other paper work before that time, so they dismissed my ars and the traffic violation with out prejudice. I have the paper work stating that. Now 2 months later i get another summons to court and i go to court and I am being charged with a dui because i guess they got my blood work back. I was only pulled over that one time. The case got dismissed and now I'm being charged with it again. please help.
It is not double jeopardy. They can refile charges up to one year from your violation.
Please help. Is there anything I can do?
I got arrested for Marijuanna DUI Sunday night. I smoked about 2 hours before they urine tested me. My car smelled like Marijuanna and they said I did not pass my FST. I added a lot of toilet water to my sample. Will that not matter? The test results will come back in 3-6 months. They didn't say they were charging me, did not get my fingerprints or picture and did not give me any paperwork. My dad has his card and has smoked in his car (the one I was driving) in the garage sometimes If I get a urine test today and it comes back negative will that open any doors?
When the test results come back you'll receive a summons telling you when your court date is. There are some things...
Two low fails on interlock, what should I do.
Dui suspended sentence, unsupervised probation
What does this question mean? How do you expect an answer?
My son was arrested for underage drinking. He is a legal resident alien. What is the real risk of pleading no contest or guilty?
Can he be deported? What is the likelihood? He'll be 18 in October, will this disappear as the record of a minor?
It depends on what he is charged with, In general, underage drinking without more, should not present a risk to his LPR...
Will going to rehab voluntarily help aggravated DUI case?
After being charged with a DUI, I decided to go to rehab. I went to a 28 day inpatient treatment center and followed up with 6 weeks of outpatient care. Went to sober living for another 6 weeks, plus individual and group counseling, and have gone to AA meetings daily for the last 7 months and have submitted to random drug tests to prove a track record that I have remained clean and sober. I did this for me, and for my kids. I was physically dependent on alcohol. I was awarded back custody of my 2 children two months ago (who were removed from my care after driving with them under the influence), and have sense then accepted a promotion at work and moved to another state. My BAC was .15, and I have court next month. Its been almost a year since the DUI. Will these factors help my case?
Congratulations on your sobriety and everything else that come with it. The rehab and sobriety will not help you DUI...
DUI- first offense in Arizona.
I was arrested tonight for a DUI in Arizona. It was my first time having any legal issue. I was pulled over after having the transmmision on my car give out I the middle of a roadway and was subsequently pulled over. I had 2 glasses of wine within 1 hr of being pulled over. I do take medication for depression and anxiety. I, in no way felt impaired. I passed all field tests, but my breathalyzer that I consented to showed impairment. I apparently had a suspended license because of an unpaid ticket for expired car tabs My vehicle was towed. I was taken to the sheriff substation and more than 2 hrs after this occurred consented to having blood drawn. I need to know what I need to do next. My income is less than $20,000 per year. I need to know what to do next and what my rights are. I've never been in trouble with the law before and this is very daunting to me. Thank you for your help.
Go to your next court hearing. At that hearing, request a court appointed attorney. Based on your income level, you...
