Does this apply to holman vs state of ohio?
If you are out for the night with a friend who happens to be an off duty officer and charged with DUI/OMVI, can the off duty officer you're with testify on your behalf that you were not acting intoxicated, erratic or reckless (holman vs state of ohio) in court?
Anyone can be a witness so yes. But he's just another witness. The jury will decide who they believe in the end. You...
BREATH TEST WITHIN OHIO TIME LIMITS?
What is the time limits on when a breath test must be performed after the alleged violation in the state of Ohio? How about time for urine? If test are performed outside the time restraints will case be thrown out or pleaded down? If no law enforcement are around when incident occurs, how do they come up with the "alleged violation time" and know when to start "the clock" for these time restraints? If there are several inaccuracies in crash report and timeline is not correct will they throw case out?
The police must obtain the breath/blood/urine sample within 3 hours of last operation of vehicle. If they fail, then...
Do I need a OVI/DUI lawyer to avoid jail time?
Pulled over and taken into Mansfield OH to blow a breath test, blew 0.094. Upon investigating, they found out my license was still suspended from a DUI in Indiana in 2012 where I used to live, but my lawyer at the time (who since has been disbarred) told me that it had been taken care of and reinstated after fines and probation. I have to appear at court in 7 days, I just got a job that doesn't start til next week, and I have very little money after having moved here about a month ago. I just want to know if jail time is likely or if it will just be fines, because I really can't swing a lawyer in a week, but I also don't want to lose my new job and have to start all over again with no license. I know I have a problem with drinking, and I'm ready to get help.
Hiring an attorney may make a difference. After all, right now the second case has not been proven yet and you are...
If you have a lifetime suspension on your license can you get them back.
Convicted of aggravated vehicular Homicide. First trouble of any kind 5 years in prison and lifetime suspension.
You would have to petition the court for a sentence modification. You would do that in the court that sentenced you.
I got an underage drinking in ohio what should i do?
I blew a .10 and was given a citation and was sent home. What should I expect to get in court? is there any way to get it off?
Only an experienced local attorney can answer your question. Only an experienced criminal defense attorney can review...
I'm an Ohio resident and received a DUI in Maricopa county
I received my first DUI (no other criminal history) back in May of 2015 and received my sentencing in October 2015. I was taken into custody the night of the DUI but was released upon a signature that same night. I've taken the DUI weekend course and paid my fine but no county jail in Ohio will house me for completing my 5 day jail sentence that was ordered. Flying back to AZ isn't an option for me and I do understand that if I don't respond back to the courts that a warrant will be issued but I would like an idea on what my options are at this point or if I were to just ignore this and move on with life, please help!?
Your options are to either go back to Arizona to do your jail time or risk having them issue a warrant for you. I would...
I was cited with a DUI last night. Tomorrow is my initial court hearing. What should I do at this initial hearing?
I am 53 years of age and have a clean driving record, with the exception of a "failure to control" citation that I was given last year. This is my first, (and only) DUI. I hit the median in the center of the highway and probably totaled my wife's car. There were no other people or vehicles involved. I took a breathalyzer test and blew a .15. - also I did not have insurance on my wife's car.
You need to go in and plead NOT GUILTY and then consult an attorney ASAP! Find one in your area through AVVO. This is...
