DPS is having a hearing for my liscens a year after DUI?
Last year I revived a DUI and after competing the court requirements the DUI was reduced to speeding 25 over. I did send off that form to request a hearing within the 15 days but when my 30 day temp license was about to expired I called the DPs and they said my license isn't going to be suspended and that I could get a copy made at the tag agency which I did. I never heard back from them until I received a letter in the mail the other day saying I have 30 days to send 175 along with the request for a modified liscens. I understand the court and the DPs are separate but why would they allow me to get another liscens just to suspend it a year later? Also what happens with the hearing? Will they more then likely not suspend me since it was reduced?

This is my 1st offense, it has been dismissed with prejudice and expunged after two years of being deferred & paying restitution. Count 1: driving under the influence of alcohol, Count 2: possession of controlled drug (marijuana), Count 3: possession of paraphernalia, Count 4: driving without a driver's license, Count 6: Fail to stop and yield at flashing red light, Count 7: Improper passing-on right. I have not had any alcohol or marijuana since then. I have learned my lesson and after paying nearly $8,000.00, I can't afford the cost of a car and the ignition interlock device. I was 20 when this happened. I am 23 now.

How hard is it to win a dps administration hearing for licens suspension?
My dui case was reduced following court requirements now 1 year later the dps is trying to suspend my licens. I called the dps and and was told the officer didn't send in a affidavit so they said my licens wasn't suspended. After I completed dui classes and finished my court stuff I called the dps back and they said to send in my certificates of completion for my classes and I was good to go. Now a year later they are scheduling a hearing for my license suspension. Since I didn't get convicted for the dui why would they be able to suspend my license. Plus they claimed they never received a affidavit?

The arresting officer was placed on the stand and questioned by my pro bono attorney. He stated that he didn't read me my rights and nor did he have a video cam etc. My attorney stated that I could have actually gotten back in my car and drove off. My attorney asked for the case to be dismissed, but the judge said no since I had a DUI 10 years ago in Texas. This case is in Oklahoma by the way. I was approved for a court appointed attorney 4 times now but they keep saying I didn't fill the paperwork out correctly. I think they are just stringing me along for court cost. I got a DUI in CA and finished all requirements and paid all fines except for the 1st offender program which is a 9 month program. I applied and received the 1650 waiver packet after moving to OK where I've received my OK license. Almost 3 years has passed and I was originally going to return to CA to complete my classes ( since the CA DMV will never accept an out of state program) Due to expenses and many other factors I don't wish to return to CA anymore for I have settled down in OK. What I wanted to know was what are the consequences of not returning to CA besides losing driving priviledges in CA? I looked in SD County and see that i still have a bench warrant even after applying for the Waiver. I wish to avoid having to make a trip to CA altogether. Thanks for any info

My son got a DUI and his attorney failed to appear at his court hearing. Does he need an attorney to request a public defender?
My son got a DUI in 04/13 and signed a plea agreement. His attorney was also his boss at a restaurant. He closed the business without paying my son which started an avalanche of financial problems, then he didn't show up at his hearing. He wasn't offered a public defender, even though he was unemployed, and for the most part homeless. He didn't know what to do, but he's been told if he puts myself on the docket they will put him in jail. A bench warrant has been issued. My son has been diagnosed with a mental illness, and he wasn't taking his medication when he signed the plea deal. This has sent him into a spiral and he makes his living with his car, so this has truly devastated his life.
