Can a Sheriff's office conduct a checkpoint on a federal parkway that subsequently leads to an arrest for a state DUI?
A local Sheriff's office conducted a checkpoint on the Natchez Trace Parkway, a federal parkway which spans Mississippi and parts of Alabama and Tennessee. There were no U.S. Park Service personnel present at the checkpoint, and a driver was subsequently arrested and charged with DUI under the state's DUI law. First, could a question be raised regarding lack of jurisdiction to conduct a checkpoint by county Sheriff's deputies on a federally-owned road? Second, does the county justice court have jurisdiction over the arraignment of the DUI that was issued by those state police on a federal parkway? Third, if these questions can be raised, on what basis can the U.S. Park Service delegate authority to police federal property to state police? Fourth, and finally, if police powers cannot be delegated to the state police on a federally-owned road, would the appropriate legal recourse be to challenge the validity of the checkpoint based on lack of jurisdiction?

Kansas Dui help out of state
I was in a motorcycle wreck in 2012 while visiting my mom in Kansas and was taken to the hospital. I was never arrested. I have lived in Mississippi for 20 years now. I did live in Kansas as a child. I just went to have my MS license renewed and was told that Kansas had a block on it and gave me a number to call. The lady at the Kansas DVM said I had been convicted of DUI due to a blood alcohol test done in the hospital. She told me I needed to write a letter stating that I was no longer a resident of Kansas and list my name, ss# address etc along with a money order or check for $25. She said I would then receive a letter of instructions to follow. Is there anything I can do?

Does the traffic ticket for a DUI that the officer issues with a date. Is that the date you actually go to court??
I ask this because my loved one has already been to court over the weekend with his 48hr jail visit for a 1st offense suspicion of dui/other. He went in in on Sunday and was released Tuesday after seeing judge. He had 2 other tickets that were already taking care of 1 was proof of insurance, Seat-belt. The court said they would send in the mail a court date. Why would they still give you these citations with a date and time at the bottom of the citation/ticket??

1st offense DUI not charged as of yet. Loved one was not read rights and did not refuse breathalyzer can he fight this in court?
Love one said no urine or blood screening was giving once sent to jail for 48hours and he did take the breathalyzer.. Is there a possibility to beat this.. Loved wasn't drunk and didn't blow past the amount that considers you under influence. He put on the ticket under the influence/other. What next other than getting an Attorney which we are doing.

Also charged with No seatbelt and No insurance. The person does have insurance but didn't have the correct card in the vehicle.at the time. The deputy said Court is on Tomorrow and I am bringing the proof of insurance on his behalf. What will happen next since we couldn't pay cash bond for the 1,500.00 (Madison County MS) Will they let him make arrangements on this fine??
