As the result of a very minor traffic accident, I was cited for "following to closely", "careless driving" and "Alcoholic beverages violation" (open container law?) I was also arrested on suspicion of DUI, but the one beer two hours before the blood test wasn't enough and that charge was dismissed. I'd like to fight the three citations I received, but how much will that cost if I retain council? The fines only total $300 and these are my first tickets in almost 20 years -
Generally it's not the fines, it's the points and subsequent increase in insurance costs that you should be concerned...
I was convicted for a DUI in May of 2012. I was arrested the previous summer for said DUI. I recently learned that the breathalyzer machine at Cumberland county prison was ruled as faulty under .05 and over .15. Can I get the DUI off of my record? Probation? Fines? Interlock? A week before I received the interlock I was pulled over for driving w/o a license. I mistakenly under the impression that I could surrender my license for two years in lieu of interlock. To sum up: Can I get the conviction and fines and such expunged? And if so, would my driving without a license charges be dismissed?

I was convicted for misdemeanor DUI almost 10 years ago at age 24. No offenses or convictions since. I would like to apply to nursing school but was warned that even if I get accepted to and complete the program I may not be able to sit for the licensing examination because I have a conviction on my record.

A relative was stopped for crossing over a while line while driving. The police searched the vehicle without consent or reason and also found a gun. During the hearing, the police produced the dash cam video. The defendant asked his attorney for a copy. When he got the video, it was different than the one he watched in the attorney's office so he contacted his lawyer and told him of this. The lawyers response was "bring that one back and i'll get you the correct copy". When he received the 2nd video, this one was different than both the one watched in the lawyers office AND the one the lawyer mistakenly gave him. He now has 2 different videos of the same traffic stop and believes his attorney is working with the police to convict him. He has both copies of the videos.
If he lost confidence in his attorney, he should find another one. However, as long as he is represented, all questions...
I received a DUI six years ago, completed ARD and it was expunged from my records. There was also an accident from 2004 (almost 10 years ago, unrelated to DUI) and it is still showing. Is there a way to have a lawyer fight to have these removed or something I can do? This is putting a damper on jobs that require a clear driving history. Thanks in advance!
Unfortunately, you are not able to expunge anything from your driving record. I am sorry to be the bearer of bad news....
