If I had a ineffective attorney and due to that I was convicted of a DUI what should I do
My attorney had proof that the police officer committed perjury three separate times in the preliminary hearing. He did not address it at the trial. I was solely convicted of the police officer testimony.
Do you still have time to appeal? If not, are you in jail? Probation? Parole? There is a collateral means of...
What are the options for getting a public intoxication expunged
I passed a car on a no-pass road and was pulled over. I told the officer I had had a few drinks and he gave me a field sobriety test. I passed the test but still blew a 0.101. The officer was kind enough to only charge me for a public drunkenness since I was compliant the whole time. I am fine with paying any fine or court fees necessary. My main concern is to get it off my record as I am looking to apply for another job within 2-4 years. What is the best way to get this off my record or should I even worry about it hurting my job application? Also I don't want to step on the officers foot in any way, he could have made it much for me.
It should not have significant impact on your record if it was a Summary Offense. However, if you really want to get...
First offense incapable of safe driving in PA
Nearly three years ago I had a DUI in PA and it was the lowest tier. I completed ARD. I never went and got it expunged, however in August of this year I got charged with a first offense incapable of safe driving. What really happens? Should I honestly be worried? The dui I went to ard for shouldn't go against me since a BAC DUI is a different charge than incapable of safe driving, right?
No. This will be a second offense with mandatory jail time if convicted. Contact a local qualified criminal defense...

It is not a guarantee of deportation but it is possible that it will cause trouble. The same could be said for a DUI...
DUI: controlled substance- prescription meds WHAT DO THEY NEED TO PROVE?
How can they prove what a "therapuic" amount is seeing as though everyone's bodies process drugs differently and metabolize at different rates? Also doesn't tolerance play a part? Drugs affect people differently so I'm just wondering how this could be proven? And how could it be proven that I was impaired due to medication vs being impaired due to tiredness? If I was impaired, I've been impaired 24/7 for years.....
The only way to do it if it is a narcotic then you need an expert witness like Dr. Saferstein.
What are my chances of getting a DUI: controlled substance (prescription meds) dropped?
I was pulled over for swerving. I swerved to avoid hitting a car. I had only been awake for no more than 10 minutes. I take several medications regularly, (seroquel, Xanax, well butrin, Vicodin, and Soma). When I was pulled over I was asked if I had been drinking, I replied with, "just my coffee". Then I was asked if I had taken any prescription medications. I didn't know that I didn't have to answer, so I just responded honestly. I also admitted to being tired. I attempted a field sobriety test, which I failed miserably. (I have chronic sever back pain which mixed along with my panic disorder makes passing such a test almost impossible.) I am on disability for my mental illnesses, I HAVE to take my medication. I've been on it off and on for about 15 years. I have seen specialists and even a surgeon regarding my back and the outcome is basically that I'm too young for surgery (28), and there's nothing that can be done besides managing the pain with medication. The pain meds have been switched up a bit and I went a period without them (due to insurance change issues), but have been taking them for a few years. I definitely have a tolerance to all of these medications.
If all the medications that were found in your system were prescription, then the first thing you need to do is obtain...
