I was arrested for a DUI with a blood BAC test result of 0.20. Will hiring a DUI attorney really make any difference in the outcome of my punishment than if I just plead guilty myself? This is my first offense, there was no accident or damage, and no one else was in the car with me.
If your intention is to just plead guilty, then no. Hiring an attorney will do nothing for you. You don't need an...
I am 18 and am a freshman in college. In October 2013, I received my first MIP. I attended the Zona Seca Youth offender program and was able to get the MIP dismissed and replaced by a disturbing the peace infraction. In December 2013 I was arrested for a DUI in San Bernardino County which i am currently fighting in court. I have a lawyer for this case but my odds are that i will take the charge because my bac was .17. Last night I received my 2nd MIP. My questions are 1. How will this MIP affect what is going on in my DUI case? Should i keep extending my dui court dates so i can handle this MIP first? Or should i settle the dui in court before my May 29th MIP court date 2. What am i looking at in terms of consequences for this MIP? My license has already been suspended effective 3/15/14
I would suggest some things -Get an attorney. No one can advise you here what to do without seeing everything. -Only...
Driving home from bar (St. Patrick's night), the light just before reaching house had turned yellow. I chose to take my chances and go through. Immediately after crossing the line, light turned red. I was pulled over within half a block. The officer did not care for "my attitude", asked that I step out of car. I completed 2 separate field sobriety tests by both officers. I'm then told I'd have to perform a breathalyser/blood test. I opted for breathalyser. This test was given SEVERAL times, due to accusations of my breathing in not out (this was not at all the case). They said I'd be forced to give blood if I didn't comply, so I then requested a blood test; they responded that wasn't necessary if I complied. Finally, a BAC of 0.18 was reached. I was arrested, without mention of charges.
You may have a defense, particularly as it pertains to the lawfulness of the initial stop. If you entered the...
My sister is an idiot. She was convicted of a DUI in January. In June she was arrested and charged with the following: M VC14601.2(A) Drive W/License Suspended For Drunk Driving I VC16028(A) Fail To Provide Evidence Financial Responsibility M PC166(A)(4) Contempt Of Court:Disobey Court Order/Process She blew off her court date in September and now there's a bench warrant issued for her. My question is, if she just lets the bench warrant hang like so many people do, will it effect the fact that her unsupervised probation is up in January?
Count on it. That may well trigger her being picked up on the bench warrant. She needs a lawyer and perhaps some...
About 2 years ago, I got a DUI. As a result, my nursing licensed was revoked, but suspended, and I was placed on probation for 3 years, random testing, and had to submit quarterly reports signed by my supervisor along with other conditions. About 18 months ago, I was convicted of disturbing the peace 415(a) of California’s penal code. The police report stated that I was intoxicated, but I was not. I received notification that my probation is extended because of this incident. About 9 months ago, I was unable to get my supervisor’s signature on a required report. I was concerned that a late report would result in my license being revoked. I got a friend to sign the report and I submitted. (I know I know). My employer discovered the incident, and I lost my job. I just received a notice to revoke probation. The reasons stated is the 415(a), not abstaining from alcohol, missing some random testing times, and the falsified report. I have requested a hearing and I am shopping for an attorney. However, I now wonder if there is ANY chance that I will be able to maintain my license. I am willing to submit to any condition and probation for any length of time. However, if this is not a possibility, then I do not wish to spend money on an attorney, or time, to fight a losing battle. What are my changes of maintaining my license if all the allegations are proven to be true?
In my opinion, the best person to speak with about this issue would be Christine McCall. You can find her fairly...
The arrest that resulted in the wet and reckless charge took place before the DUI arrest. I was convicted from the second arrest for a DUI before the first arrest was reduced to a wet and reckless. Does this count as a second offense regardless of arrest/sentencing date overlap? How does this effect my DMV suspension?
The DMV controls your driving privileges, not the court. What happened at the admin per se hearing on your DUI that...
I have a CA DL (have never had a license in any other state). In May 2012 I was arrested for DUI in CO while there for work and my privilege to drive there was revoked for three years for refusal. Since then CA has taken no action on my license but it's my understanding that it is likely that at renewal time is when CA will check NDR and reciprocate the suspension. My question is; my renewal comes up almost exactly two months before the 3 years will be up (March 2015). Does this mean that the suspension would only be valid until the three years CO revocation is up A) in general and B) even if I have outstanding issues on the legal side related to the DUI charge? Are the courts and DMV/MVR separate to some degree in CO as they are here in CA?
The first thing to do is order your California driving record (H-6) on the DMV website to see if the Colorado action is...
