My son was a first time DWI offender with over .15 blood alcohol level. He was required to put in an ignition interlock device 6 months prior to license renewal. The device was installed but now we have a problem. He cannot get insurance on the vehicle because as the owner of the vehicle the insurance company will not insure the vehicle without the owner having a license. So the insurance company is recommending to turn in the vehicle plates and registration. But the interlock device has to be recalibrated every 60 days and you have to drive the car to get it recalibrated even if you are not using the car. What can be done about this mess.
Answer: If possible, have him sell the vehicle to you or someone else, with a new title and registration being issued...
restore. The women @ the DMV said did u take IDRC? (i probably should have said yes, right?) I said no & she restored it & said i need to go 2 IDRC right away b4 i get in trouble. Also, the judge never told me 2 go IDRC when he suspensed me. @ IDRC they recomended I go 4 treatment eval @ rehab. I went for the first few weeks. Some kid there who is on parole told me he skips it once in a while. i figured I am not on parole&if he can skip it mayb i can. i did. 3 wks. Can they suspense my license for 4 showing. my reasons for not showing are: 1 The group gives me panic attacks&i was told while enrolled I cant take my anxienty meds. 2 i made the mistake of having coffee after 1 group w/said parolee & he stalked my phone asking me "if he scares me". I was scared 4 my life. Can they suspend me
The failure to complete the IDRC course can cause you to have your license not restored or taken off the revocation...
I need help I had three devices sent to me within a month because it was defected. I need to know how I can get away from this company without being penalized, and I have asthma its so hard to blow in that device. I don't drink and the machine keep failing me. then 5 minutes later it passes me. but the company charges every time the machine gives a test fail response. what can I do this machine is set up for people to fail, for no reason at all. this was my 1st offense and will never happen again. but I cant continue with this machine or the company
This is a new issue to my knowledge. This was ordered by the court. So a motion for relief could be filed with that...
I was pulled over for blowing a stop sign and cop thought I was intoxicated. I did the road side tests and blew into the machine registering 0.0. Cop then asked me to give a urine sample because he thought I was high. I refused. Cop ticketed me with a refusal and running stop sign. Am I obligated to give a urine sample like I would have been obligated to blow into the machine?
No, the Implied Consent Statute does not apply to urine samples - only "samples of … breath." N.J.S. 39:4-50.2(a)...
A cop thought I was drunk while driving, I took the test on site and passed it. But he still took me to the station. I got fingerprinted and took a picture, they told me if I didn't pass the breatherlizer that I would be held there. I passed it 2 additional times and then they told me I was free to go.
You could have passed the Chemical Breathtest and still be charged based on the officer's observations. Keep an eye...
I could have gotten my license back May 2013 but didn't as I really don't need to drive since I take the train for work. I am going to go to get my lisence (finally) and wanted to know if I still need to have device in my car for 2 years? It has been 7 months after my 2 years and heard there may be a new law that only requires a year. Do they count time that you got license back but didn't pick up? That interlock is a real hinderance and embarrassing to say the least. I have not driven in 3 years as is. Hoping for the best. This is the gift that keeps on giving for sure.
Yes, you will have to install the interlock. No, there is no reduction for time spent without a license. The duration...
Long story short. I have a DWI hearing on 8/18. I will be found guilty and have my license suspended (I'm 28 y/o with a prior). I need a photo ID for work, and I cannot get a passport in time by 8/17 (trust me, I've checked). I cannot risk NOT having a photo ID. The quickest way to get one is to get a state non-drivers ID. To get a state ID, I must surrender my drivers license (NJ doesn't allow you to have both a drivers license and state ID). Question - does voluntarily surrendering my drivers license cause me downstream issues with getting it back once my DWI suspension is over? I'm not looking to get out of suspension. I'm not looking to have this "count" towards my suspension. I just need to know if me surrendering it voluntarily will cause me a problem once my suspension ends
Generally, surrendering your license doesn't have any affect on your drivers license, but speak to a licensed NJ...
