Incorrect or missing information on a police officers statement
I live in Ohio but was arrested in Indiana on a lake for BWI (Boating while intoxicated). I just got a copy of the police report and some minor things that the officer stated were incorrect but the largest mistake was that he stated he "handcuffed me and walked me to his state issued truck" ... a little hard to do when we were on the lake. Additionally he left out all of the information with regard to the 3 others on my boat, his requirement of them taking a breathalyzer AND administering one after advising them that they could not move the boat unless someone was sober; the fact that he stopped me for a stern light not illuminated after sunset was not mentioned again in the report nor that he left 3 passengers on a disabled boat with no working lights after dark in the water.
The errors are minor and will be talking points for the criminal defense attorney you hire to defend you in this case!!
Is a statement given to police while intoxicated valid in california?
My boyfriend and I got into a fight while in California. I was extremely intoxicated and don't remember most of the details. He was arrested for domestic violence based on statements I made. I don't remember what statements I made to the police and not sure why they charged him. We are Ohio residents and I really don't want him going to court for something I can barely recall. He has no previous history of abuse and has never done anything to me before. Do I have any way to stop the DA from prosecuting?
California will admit any statement as evidence if it was voluntarily given. The question as to whether it is a true...
Is house arrest possible for a 4th dui?
i have done numerous hours of research and read that in very few cases, house arrest is possible...what i would like to know is what is the chance of house arrest in lieu of incarceration for part of the sentence?
4th OVI in 10 years? Absolutely not. By law, the felony charge carries mandatory jail (more likely prison though)....

Will a DUI affect my application for change of status?
I came to the US with a B1 visa. My wife came to the US with a green card and she is still a green card holder. She immediately filed for me as her immediate relative . It's been a long wait process. I was told my priority date has to become current before my wife can file for a change of status for me. After more than two years of waiting, my priority date is now current and my wife wants to file for a change of status for me. She is not a citizen yet. I fear two things; 1st i have been out of status for almost two years now, 2nd, i had a DUI some time last year where i i was placed on two years probation. My question is whether my wife can successfully file for a change of status for me given the circumstances and secondly, will my DUI record affect this application?
To adjust status based on a preference petition you must be in status. You will not be permitted to adjust status until...
Do I need a lawyer/help for my daughter? Snowy weather, lost control, hit guardrail, citation from city
She was driving in bad snowy weather. Road was filled with potholes and lots of snow and ice. On an exit, (full circle), She lost control, almost hit concrete divider, got away from it but ended up hitting the guardrail front on, on the other side of the road. The cops said she must have been going fast but she thinks 40 at the most, and they cited her for hitting the rail. Nobody else was involved. A passerby kept her in her car until the police arrived. She was very shaken and declined the ambulance. She is new to driving, 2 yrs. The car is a 98 civic. Husband said he only had liability on it. We took her to ER, they referred her back to her neuro, bc she has medical conditions which make her high risk for injuries. She is supposed to wear her neck brace until then. This ER only did basic CT of neck in ONE position, and xrays of spine in ONE position. Does she need a lawyer for court date & citation? How DO people get through these? We just cant catch a break. My family has had several medical and financial nightmares caused by bad drs . I am worried that she needs a lawyer-hubby just wants to pay whatever fine and let it go. Is this right? I want to do this right.
You have multiple issues. On the accident itself, she is PROBABLY charged with failure to control which is a minor...
