Dui in Dec 2012 received 9mos suspension and did level two classes. DMV still wants me to have breathing device in car for two yrs @ $70 per mo. A friend said, he got same and his case was dismissed also. He then brought civil suit against DMV and he paid the court fees 2 or 3 hundred $ said Judge dismissed all He said he has done this twice, bringing civil against DMV one of his dui was riding a bike. He said court only wanted the fees. Is this feasible? Thank you, John
You are dealing with two totally different standards of proof with a criminal case than you are in an administrative...
If i was convicted for a DUI in the military and did the punishment already can my state prosecute me
I was Convicted of a DUI in germany almost 2 years ago. Under the SOFA agreement i was handed back over to the military. i did my punishment and everything is good to go. now i find out that my state is trying to revoke my license for a year after i had already had my driving privileges revoked for a year and a half plus my other forms of punishment. can my state to this?
It's possible. I practice in Leadville and the DMV on a regular basis. I need more information to really answer your...
Third DUI conviction, the previous one was less than a year ago and the first was about 3 years ago. What are the penalties?
The reasons for being pulled over each time were for minor traffic violations.
JAIL. Lots and lots of jail. 3 offenses within 3 years in El Paso County and you will be extremely lucky to only get 6...
How can the state convict someone of a crime with absolutely no evidence other than an officer's testimony?
I was charged with DUI/DUI per se for drinking a beer inside of my parked car. We had our doors open for airflow with our legs sticking out and my keys were in my pocket. The officer, who rode up to the side of my car on a bicycle, wrote in his police report that I had the keys in the ignition. He flat out LIED! This officer was a complete jerk from the beginning of the ordeal. They cuffed me, didn't read Miranda rights to me, and took back to the police station where I blew a 0.105 BAC. My friend (and witness) who was in the car with me when this happened wrote a statement re-emphasizing that the keys were NOT in the ignition. How can they convict me of a DUI if it's mine and my friend's word against a cop's word?
Simply put, because the jury gets to assess the credibility of any witness and they believed the officer over you and...
Facing DUI Charges, don't think I have received a notice of revocation or anything.Heard a BAC from bloodwork could take months.
I have paperwork but nothing has implied revocation yet in the paperwork. From what I understood from the conversation before I decided on the method of testing, because I took a blood test I was able to hold on to my driver's license for now.I got my driver's license back before being dismissed from the hospital and have been checking the mail daily because of my friend's advice but have yet to receive any other news. It's only been roughly two weeks but I'm feeling increasingly nervous because I am told I have to request a DMV hearing using the notice within a week or face not having a chance to try and get it back. I am also concerned about what may happen if it gets lost in the mail or sent to the wrong address because I moved recently and gave them a different address from my license.
First and foremost, seek the advice and consultation of an experienced DUI attorney, not a friend. You need to make...
I recived a dui and pled it down to dwai and now 14 years later they are making me pled to my new dui as my second
unfortunately, Colorado allow a lifetime look back for prior DUI offenses. Nobody can force you to accept a plea...
I was stopped on jan. 20, 2014 for a dui. i was underage and drove with only a drivers permit. i was taken in to the hospital to do blood tests. It is now march 15 2014 and i still have not received any letter from the court, dmv, or lab test. I was assured by a lawyer that i would have that in about a month? i am wondering what i should do? will my case be dropped if they lose the blood tests? is there any way i can keep my license?
You simply have to wait. Because of numerous problems, the CO Dept of Health had to close their labs. So, law...
