Is your 4th DUI in 7 years considered a felony? What is likely to happen?
In 2013 & 2014 my boyfriend has charged with his second and third dui, those were both within the 6 yrs and he was put in mental health court in our home town county, today September 7th he is being charged with technically his 4th dui but it's been over 6 years (so 3 in 6 yrs) in a county near by.. He did have a bond set at 4,000$ his arraignment is tomorrow morning.. Is he likely to get out if the po doesn't put a holder on him?

I got a dui in california last october, i after that had my license reinstated after signing up for alcohol classes and getting the idd put in my car, last month i decided to move to ohio and i was informed i could get a license here after waiving my rights to have a license in california for 3 years. After i moved to ohio i called the dmv mandatory actions unit and asked them to send me that waiver packet and they said i can only get it after my suspension period is over. So my question is , is there no way to get a license in the state of ohio until my suspension peroid in california is over?

yesterday i boosed 4 pegs of whisky and after 20 minutes my friends asked me to drop them to nearest club in my car. So i drunk and drove the car for 36 minutes till the club and at last moment police came near my car and told me to come out and asked me to do some simple excersizes so i did it with out any mistakes. And he asked me to do breathe test i gave it and after some time he asked me to do second time then i refused to do that. I told them that i simply came to drop my friends to club. How can a specification to an ovi carry more time than the main charge of an ovi?
In September there was a decision in the Ohio Supreme Court in the case of Edward South, The Court found that the maximum sentence for a third degree felony was 36 months. If this is in fact the case then how can the specification still carry a 5 year maximum when it is supposed to be an enhancement to the Third-degree felony OVI charge. i understand that it was legislations intent but how can you receive more for the specification then what the actual charge carries?? It seems that legislation is treating the specification as if its a charge in itsself? If thats the case then its Double jeopardy because you need the same elements to obtain the third degree felony OVI as do you with the specification which is 5 in 20 years.. The law states that you cannot receive more than time than that of the most serious of crimes? so that would mean that the spec would have to be the dominant charge and therefore sets alone instead of being an enhancement?
