DUI VOP question
My father had court today for VOP for a DUI. The state offered 20days in jail. My father cannot do 20 days in jail at this time, due to financial problems and needing to relocate out of state. He plead not guilty because the public defender said he had a good chance of beating it. (Violation was due to finances and illness) My question is, if he doesn't beat this charge, is he looking at 20 days or is he looking at the full time for a DUI charge? Aside for the last two months that he's been in and out of the hospital, he has been current with alcohol classes as well as paying his fines. I was on Felony Probation for 4 years for damaging property. I Violated curfew with 6 months left til completion of probation. I was on the run for 2 years. I finally got arrested for driving on suspended driving license due to child support first offense. There was a legal blood draw completed for an accident with serious bodily injury. The Officer who went to the hospital to collect the blood (Womack) wrote the accident scene investigators name (Nash) as the recipient of the blood and the 1st entry on the chain of custody. They BOTH later said in separate depositions that each officer personally entered the blood into a refrigerated evidence locker #19. 27 hours later, the PD Evidence room manager (Storey) came in and documents that all evidence collected the night of the accident was found in SERB (secure evidence room box) or drop box, where she later placed each item in its appropriate place for storage. The manager (Storey) has no signature entry on the chain of custody. There is a form that has a date of 8/21/12 showing the blood was pre-logged for delivery to the FDLE. The chain of custody shows 8/24/12 and signature for the pre-log and transport to FDLE. 2 entries have an officers name misspelled show someone else obviously signed. Pictures taken of the kit at a later date show tape on the box with BS ( B. Storey) again, no 1st or 2nd entry on Chain log showing that Storey handled this evidence

Good afternoon, my question is regarding a family member who drove while intoxicated. The arrest report mentioned a 0.3 (.32 or .36, I don't recall the exact number) blood alcohol level, he was taken to the hospital and released. There was a minor fender bender and no one was injured. I read that there are harsher penalties for higher blood alcohol levels, but I was wondering if there are any strict "must serve jail" sentences imposed on something like this. He has seen a public defender, and she has stated that the state has not gotten back to her yet on a possible plea. He is currently under a Marchman act, and goes to court ordered treatment and AA. The Marchman came after the DUI. He has no criminal record aside from this and is 64. Thank you for your time.
