Specifics on taking a plea bargain of a DWI case. I blew .005 under the legal limit of.
in July 2014 I was arrested and released with my license handed back to me for a DWI where I have lived .005 under the legal limit. When I went to court nobody had any information on this case, hence I thought it was dropped. 6 months later while on vacation I received a letter that I was to go to court the next following day. I was in Arizona the case was in Missouri at the time. Here I am numerous mOnths later back to Missouri with an under paid lawyer, con about te accpt a plea deal on Tuesday for prescribed medication and .005 limit of alcohol combined and which they're offering me 2 years unsupervised probation taking it down to Misdemeanor driving without a license and then after 2 years of successful unsupervised probation will be completely off my record. I don't think this is a
What is your question? No one here can tell you whether to take the deal - because we don't represent you and don't...
Can you recieve an MIP while at home with your mother?
My brother and a friend were at the house drinking wth our mother. There was a noise disturbance, so we stopped dancing, and they gave the friend an eye test...he passed. They got another call and came back and gave all three of us MIPs, but i heard if your mother is present they cannot do that? And as for the friend, he had permission to be drinking with my mother, brother and I. The officer told my brother he was calling his college, but they cant do that without him actually being convicted. As for them knowing alcohol was consumed, the officer gave us each a breathlizer and never told us what we blew. There was no proof of anything besides an unopened bottle of alcohol.
Are you under the legal drinking age of 21? If not, you cannot legally consume alcohol, whether your mother is present...
Is there a way to avoid an interlock restriction due to refusal to submit to a breath test?
2009 refused to take breathalyzer test. Automatic 1 year driving suspension, followed by one year restriction to drive only with interlock. I moved out of state during the suspension period and got a valid drivers license in that state. Now it is time to renew and home state will not let me, even though my license is valid in that state, due to the other state has flagged that I never did the interlock. Over 7 years have passed, no traffic issues and certainly no driving under influence. Is there a way to not have to do the interlock. It will definitely cause me to lose my company vehicle, and potentially my employment. Please advise if there are options. Thanks for the help.
You moved out of state to merely avoid an IID? You must certainly love your drinking and driving.. Contact the...
I was pulled over for fleeing the scene of an accident that never occurred. I was then arrested for a dui. Can I appeal?
The "accident" was never recorded or reported. Friends who saw me leave verified I did not hit and run. Pulled over, arrested. Placed in locked police car with the windows up and no a/c in 90 degree weather for almost an hour. Made me angry and I lost my temper. Refused to cooperate, acted petulant. Was infuriated. Over the top behavior. Diagnosed with bipolar less than a month later. Convicted and I want to appeal. My lawyer did not fight for me. Cops falsified report by claiming I hit and ran, abused me while in their care.Road side tests not performed properly (no shoes, uneven surface, hurt ankle). Never offered me medical attention for heat stroke, didnt even offer water. Fear and stress triggered ( bipolar) manic out of control behavior. Do you think I could win my appeal?
If you were tried in a city's municipal court you have the absolute right to appeal just by filing an appeal and paying...
DWI on Tramadol?
I hear mixed answers in Missouri on this question. I'm getting ready to get back to work from a on the job injury and I'll be on Tramadol when I go back. I am a non-commercial D.O.T. driver. So, if I'm on extended release Tramadol and it does not mentality impact me, then am I legal to drive or is that still grounds for a dwi?
Any time a prosecutor can prove by a reasonable doubt that a driver is driving a vehicle while impaired then any drug -...

Do I have to wait to get my license?
I was on 10 year denial and my licenses and is supposed to be reinstated this year (2017). My license was suspended in November 2007 and I was just wondering if I have to wait until November 2017 to get my license back. The reason my license is suspended is that I had three DUI's but one is questionable.
Based upon your post it appears the 10 years won't be up until November.
