Oregon - Is ignition interlock, SR22, limited driving required for hardship permit if DUII was dismissed?
Driving Privileges currently suspended under DMV implied consent law (refusal to take test). All charges have since been dismissed related to the incident (DUII dismissed). Coming up on 90 days of suspension and wondering if there is a case to make to A) not install a ignition interlock and B) not have an SR22 and C) have hardship permit without any limitations. Before the charges were dismissed we did have a implied consent hearing where a judge ruled to maintain the suspension. Since there is no reason to believe there is an alcohol problem (case dismissed) it seems like the law should allow for some "leniency" for this situation. Is it something a lawyer could help related to the DMV judge? Is there any allowance to "be heard" in relation to this?
