Open Container Violation
I got pulled over and was found with a basically full open beer in my car.I'm 23 so I admitted to having a sip and it was a stupid Idea. I received a ticket and when I looked at my ticket the officer screwed up my last name by leaving one letter out. He also screwed up my driver license number by one digit as well. I also never signed the ticket. So I was wondering should I fight it do I have a chance of it being thrown out. Should I pay the fine and go on my way or do I have a chance of it being thrown out.
I would not recommend trying to fight the ticket on the grounds that there were minor typos on your citation. The...
Underage DUI in Oregon... Help me...
Just last thursday I was convicted of DUI, reckless driving, reckless endangerment, and hit and run. I am 17 years old and the other individual in the car is 18. We hit a telephone pole, and I ended up running. (I still do not remember getting in the car, crashing it, getting out, ect.) most of the situation is very suspisious and I believe my friend may have driven. I am being charged with these crimes and the officer said "there is a witness saying he saw me driving" yet my injuries don't match up with sitting in the driver's seat. Is there any way to fight this, is there any way I can get out of the other charges, is there any way I can hold onto my license, what can I get out of the DMV implied consent hearing, and what can I expect with the whole overall situation?
It doesn't sound as though you have been convicted. It sounds like you were only arrested and are being charged with...
Got cited for speeding and failure to install iid. But it was the company car. Will the courts kick me out of diversion?
No criminal history. First time offender for duii. Currently in diversion.
It's a condition of your diversion that you not drive without an interlock device. You will likely receive a letter...
Can I take the reinstatement classes in Oregon if I got the DUI in California?
I got a DUI in CA about 6 years ago and have not driven at all since then. Now I have been living in Oregon for about 4.5 years. I went down to court in CA and got all of that straightened up, but now I need to take the classes to get my license back. Would I be able to take the classes on Oregon rather that California because I live in Oregon now.
You can certainly try to do that in Oregon! You aren't the first person to move after DUI conviction!! Oregon may...
I was charged but not arrested for duii and reckless driving in oregon. What should I do next?
I consented to a breathalyzer and a urine test then was taken to the precinct took the tests and was released. There were no passengers in the vehicles I struck and I blew a 0.04.
Sounds like you were arrested but not charged. Report the accident to your insurance carrier. Be truthful with them...
How do I postpone arraignment for dui and possession of control substance. Can insurance get my car?
I was pulled over in Sutherlin or and charged with a dui after needles with drug residue were found in a search of my car . I have a arraignment on the 10th coming up which I am not at all ready for. I still need to get my car from impound . How can I postpone mine and my girlfriends arraignment? I'm still trying to get money together for an attorney. Can I pay a small fee to have an attorney change the date or do it myself?
For arraignments on misdemeanors, Oregon law provides, “When the accusatory instrument charges a crime punishable as a...
If my conviction says my license is suspended 3 years, how can the DMV now say it is a 5 year?
In 2010 I was convicted of DUI, Assault 3, and Failure to perform duties as a driver. I did time and received a 3 year DMV suspension. I got out Aug 19, 2012. I waited one full year and I applied for a hardship license. I followed all the steps and was approved. In 2013, I am POSITIVE it was only for two years. In a couple days it will be two years on hardship with NO infractions. I called them today and they said I have another year of hardship and 3 additional years with an SR22. DMV quoted § 809.411¹ (C). Are they right? I am POSITIVE when I went through the process it was only for two years.
If you received a three suspension I assume the enhanced suspension was due to you having a previous conviction in the...
