Texas- my son has a court ordered interlock for a dwi but his car has been totaled and is inoperable. How can they Enforce this?
Harris County, TX. Today, I found out that the court has ordered my son 6 days in jail, 32 hr community service, $200 fine and to install a interlock system on his car for a Dwi he got New Year's Eve. His car is totaled and we have no intention of fixing it. The battery was even stolen out if it last week. He lives on his own and does not drive now. He has to hitch rides with friends. How can the court enforce the installation if this device?
The court can not require him to possess a car. They can only require that if he drive, the automobile must have an...
If I got my first dwi dismissed would this new charge of dwi be my second?
I got my first dwi in December of 2014. I was placed for probation for a year and it was very strict because i wanted to get it removed from my record. I completed everything I was suppose to do so it got dismissed in March of this year. Unfortunately I just got pulled over again and arrested for dwi. What's going to happen and what should I be expecting?
This will depend or whether you were on Deferred Adjudication, or Straight Probation. It also depends on the facts of...
Could I face jail time for violation on my in home DWI breathalyzer?
I am currently still in an open case for DWI and conditioned to have an in home breathalyzer for the remaining time of this case until closed and I blew a violation just this once and it let me retest but came to violation again and I have court next week for this reason but I wanted to know if I could face jail time for it, or what consequences am I looking at?
Since you have the breathalyzer, not using any alcohol is a condition of your bond. The worse case scenario -...

What will most likely happen in my case, where I have been put on adjudication probation for aggr asslt ser bod inj. I have completed an inpatient program for six months already, current with fees and everything, but when I was released I started making bad decisions again and I failed two drug tests as well as picked up a possession of marijuana case under an oz. I don't consider myself a hardened criminal rather a knucklehead. But I have just now recently missed my court date. I'm 23. Will the court show sympathy in TX?
The short answer is "no" way. You got your break with probation on an aggravated case where someone was seriously hurt....

Can I get my address changed and have a conditional licence in Texas?
I was convicted of a dwai in New York just recently. I've paid all my penalty fees and have a conditional licence. I'm suppose to be moving to Texas in a month and was wondering if I'll be allowed to drive down there with a conditional licence?
This is probably a question you should contact the Department of Public Safety (DPS) about. Driver License Customer...
Texas concealed handgun. DWI guilty charged.
I was convicted with a DWI at the age of 18 years old on November 2011, ended up violating probation on June 2012 and did time served. I am now trying to apply for a CHL as I saw it says "has not, in the five years preceding the application, been convicted of a Class A or Class B misdemeanor, or equivalent offense, or an offense under Section 42.01 of the Penal Code (Disorderly Conduct) or equivalent offense," Would this mean five years from when I got the DWI on November 2011 or after I was released from jail in 2012? I am wondering if violating my probation will have effect in this matter or will I be good to apply for the CHL as of now.
The seminal date is when you were convicted, which for a dwi would be the date you went on probation.
