I want to know if I was charged with DUI.
I was drunk sitting in my car. police came and talked to me but i dont remember what they said. I know i didnt do a breath test or anything. But when i went back to my car in the morning my registration papers were on the passenger seat. I would like to know if i can be charged with DUI, and if so i didnt receieve any papers. Will they mail them to my address on the registration? or should i not worry about this, as they would have to do more to charge me?
It would seem that you should be in a better position to answer that question than any lawyer (who was not there)....
Can I get a reduction in my fee to purchase my license back after a DUI?
When I was 18, I received a DUI in May of 2015. I hired a lawyer and completed all of the requirements made by the judge, like going to a One-Day DUI Class and paying legal fees. The only thing I didn't do was purchase my license back for $700. I am almost 20 now and a college student about to go on a six-month missions trip overseas where I will not be employed. When I get back, I will still be in college and unable to afford the fee, but I will need a license. Is there any way I can get this fee reduced/waived? I have not gotten into any legal trouble since my DUI, if that makes a difference. Would I have to go to court again?
I'm afraid not. It's an unforgiving administrative cost.
Is there a way to keep my drivers license after being jailed for a DUI until I am formally charged?
I was driving home to MN from CO. I had been drinking & pulled up to a pump at a gas station in Nebraska & had passed out. I was woken up by police & then jailed. After going before a judge the next afternoon, I was given two court dates I must appear for. These court dates are 8hrs away from me & I don't know how I can possibly get there without having a valid drivers license.
You must file a Petition for judicial review within 30 days of your license revocation. A hearing will be scheduled...
Can a traffic accident be a basis for reasonable articulable suspicion of DUI/DWI, or is much more needed to determine that?
What is all needed to prove a reasonable articulable suspicion in DUI/DWI accident case? If there are no reasonable suspicion, how far can an officer expand the scope of the traffic accident stop when investigating possible crimes?
It would depend on the totality of the circumstances. Perhaps the officer would note an odor of alcohol or something...
If I move from CA to MN, will a DUI conviction from CA be placed on my MN DMV record?
If so, how long until the conviction disappears from the public record? Also, I've completed everything I need to do in CA to get my full license back (including finishing the 3 years of the SR-22). Will the MN DMV have me jump through extra hoops to get a MN license (like take MN's alcohol class)? (I've listed the question as being asked in the city I'm looking into moving to in order to get the attention of MN attorneys, even though I'm still in CA).
A dui on your record never "disappear" from your record. Your CA. DUI conviction will be on your record. Get your...
Will I be liable for my roommates alcohol possession/consumption while on DWI probation?
I live in "employee housing". Its a three bedroom home that only long term employees can live in. I have no lease, and I don't get to choose my roommates. My current roommate likes to drink and keep beers in our fridge. I am on probation for 3rd degree DWI, and am concerned that my P.O. will show up and search the house, find his beer, and hit me with a violation. I would test clean, but would that even matter? Would it still be considered my possession? How do I avoid all of this?
I'd be concerned too. How to avoid this? Live somewhere where there is no alcohol.
What should I do? Its my first DUI.
I cant afford a lawyer. I asked the Judge to provide me a lawyer but he wont. Wouldnt that violate the 6th Amendment? I also tried to find the local bar association in Winona but I cant find it anywhere online. Its my first time getting DUI so im clueless on what to do.
You only get a court appointed lawyer if you qualify financially. You must make or have too much money. The threshold...
