Is it possible to plead for a wreckless driving charge rather than a dui? Is jury trial required to do so?
I am facing a 3rd dui charge-I was arrested way back on July 9th of 2010-I completed the dui risk education classes on Dec.20th-2010 - and drove-successfully w/ an intoxilock device in my vehicle for a full year. I have not gone to court yet -is there ANY WAY I can try to get out of the 3rd dui charge? I know I could be facing jail time-and would gladly submit to that-if I could get a lesser charge. Would that help my case? And....if I get sentenced w/ the dui-and it goes to the state-and my license is revoked-is there a period of time-required by the state-that I HAVE to go w/out driving at all? I plan on paying an attorney to go to springfield to make an attempt to get my driving privledges restored or at least a driving permit of sorts.

I was in a car accident 4/17/15. I was taken to the ER and examined. I was given Tylenol extra strength and Ultram. The hospital didn't write down I was given medication. I had to leave blood and urine samples. 8 months later, I receive a letter in the mail saying my license will be suspended for 6 months because of what was found in the blood and urine samples. I contested the suspension and in court found the only thing found in testing was Acetaminophen in my urine. I told them that acetaminophen was Tylenol and not a controlled substance. They didn't believe acetaminophen was Tylenol and upheld the suspension. Every person I have spoken to says this is wrong. 3 things. First the samples were taken after I was released from the ER and not before. Second, according to one attorney, a illicit drug test would not have detected acetaminophen but a medical test would have so I was given the wrong test. Third, acetaminophen is over the counter medication and is not controlled. The suspension will be up next week but I don't want a false DUI on my record and I want to find out who said acetaminophen was a controlled substance and take legal action against them.

Do out of state DUIs carry over?
So, my girlfriend was arrested yesterday afternoon for driving while under the influence in Rockford, IL. This is her 3rd DUI, but it is her first in the state of Illinois. She had gotten 2 DUIs almost back to back in Michigan about 2 years ago, but was able to walk away after 10 days in jail and without probation. To date, she owes the state about $6,000, and technically has a warrant out for her arrest in Michigan due to unpaid fines. I'm curious if the DUIs will carry over, because right now her bond is set at $300, and that seems awfully low for someone with her DUI history. Isn't a 3rd DUI supposed to be a felony, anyway? She had gotten into an argument with someone and fallen asleep in the car (which just so happened to be in the middle of a parking lot). Someone noticed her passed out in the car and called the police, who then knocked on her window and proceeded to question her. They got her with 5 charges: DUI ALCOHOL/INTOX COMPOUND/DRUG; POSSESS DRUG PARAPHERNALIA; POSSESS CANNABIS 2.5-10 GRAMS; DRVNG UNDR INFLU/BAC 0.08; TRANSP/CARRY ALC LIQ/DRIVER. I know she had a bunch of opened containers and cans in the car. What is likely to happen if she is not bonded out?
Convictions from other states carry over to other states. You know she needs to get a dui attorney, help her do that....
What can I do about court fines for a DUI?
Hello, in 2014 I received a DUI in Cook County, Illinois. I was sentenced to 2 years probation, 90 hours of Alcohol abuse treatment, 200 hours of community service, Impact panel session, revoked license, probation fees, required to pay re-instatement fees for my drivers license, and lastly $2,914.00 in Court fines, I have completed everything, except, paying my reinstatement fees for my Drivers license which I believe is $550.00, and the $2,914.00 in court fines. Probation fees, treatment, and community service have been taken care of, but with me being disabled and on a fixed income, of 871.00 a month has made it nearly impossible for me to save the money for the court fines. The most difficult part is the fact that I live 4 hours away in western Illinois away from Chicago. My probation will becoming to an end in December of this year 2016. I was told that I am to pay my fines in full at my last hearing in Cook County, less the reinstatement fees which will be sent to Springfield. I do not know what to do about the fines. I would like to know if there is some leniency when it comes to fines? Thank you for your time.

I got arrested for BWI in Missouri with no accidents or bodily harm just a stern light out. The officer said they do not report that to the IL Secretary of State because in MO they say a BWI has nothing to do with my motor vehicle record. I am back home now in Illinois and still have my license. I am concerned that Illinois could try and do something on the criminal side of my old DUI if I don't beat this BWI charge in MO. Technically they are separate offenses so one should have no bearing on the other. Also I didn't blow on the BWI which the officer said that only matters on DUI and DWI.. I hired a lawyer from MO and he is 95% sure it shouldn't be an issue in Illinois. I was just curious what anyone else may think. I haven't found too many situations like this between IL and MO..Thanks

A friend of mine was arrested for a DUI 2/14/2015 with a BAC of .24. Currently the case is still open, he should be sentenced at his next appearance. However, he was picked up on 4/9/2016 for an AGG DUI, no valid license and leaving the scene, among other charges. I know of someone who has managed to escape jail/prison time, although they have been found guilty of 3 DUI's and the 4th the DUI's was dismissed. They wore an ankle bracelet for 30 days for the 3rd DUI, but no jail time! They recently got caught driving drunk again while on a suspended license, so technically #5!
