Can I get a DUI arrest dissmissed because police officer did not turn in any paper work??!
I was arrested for a DUI a year ago. I went to court 30days after my arrest and they told me that the officer never turn in any police report. They said they will send me summons to when to appear again. Well is being a year and still nothing. Can I hire a lawyer to have this dismiss pr have some type of agreement? Is there a statue of limitations on this?? I need to have this resolve because I want to become a US Citizen and they dont want me to have any pending cases. Thats what an immigration lawyer told me.

What will most likely happen when I go to court?
I'm on non-reporting probation for speeding, running a stop sign, no drivers license, failure to appear, and driving on a suspended. I paid off all my fines and the court clerk told me that meant my drivers license would no longer be suspended but I never followed up on it. Yesterday I got pulled over and charged with driving on a suspended (even though I was told it wasn't) and the cop technically arrested me but released me with a court date. What will most likely happen in court? Will I have mandatory jail time? I'm 7 months pregnant and I have a one year old so I'm very scared to go to jail! I don't have anything else on my record besides these incidents.

I asked this question the other day: "If I attend a party where underage drinking is taking place, and I am over 21 myself, can I get in trouble if the cops show up? Plus, are there lesser or greater issues if I am also drinking or not drinking?" I got this great response from J. Steven Neighbors, Criminal Defense Attorney in Overland Park, KS: "If your are not "hosting" the party, and you were not participating in the assisting of minors to obtain alcohol, I do not see how you could be prosecuted based upon those facts alone. Just "attending" a party, without more, would not make you a culpable participant..." My question now is: What if I am around to be a Designated Driver? My college is looking into a program to allow drinkers to get a ride home after parties, no questions asked, for free, so that students have a safe path home. The idea behind this is that some students will drink no matter what, so why not provide a way for them to get home that doesn't get anyone injured or killed? I'm all for this, but want to know the legal ramifications if I am a DD waiting inside the party house for these students and the cops show up?

Does a Kansas DUI Diversion need to be listed on a State of Arizona Application for employment? It asks for convictions....
I am confused by the language of the Arizona application for employment, in reference to DUI's it states: "Crime" as used in this section means any and all felonies, misdemeanors and serious driving offenses including, but not limited to, driving while under the influence of intoxicating liquor ("DUI") or drugs, extreme DUI, or any other driving offense that is a misdemeanor. "Convicted" means you have been found guilty of a crime by a court or jury, or have pleaded guilty or nolo contendere ("no contest") to a crime and have been sentenced for a crime, whether imprisoned, incarcerated, placed on probation, fined or received a suspended sentence. Kansas has a pretrial diversion program which means the charges are dropped after you complete their prescribed actions. So I know that my case was dropped and I was not convicted but are they using conviction in the strictest sense of the word or a broader definition. Obviously I don't want to put my DUI on my application unless I have to, but also don't want to be disqualified for being "dishonest".
